This article discusses the key methodological shortcomings of experimental regulations and regulatory sandboxes. I argue that the poor design and implementation of these experimental legal regimes have both methodological and legal implications. The deficient design of experimental regulations and regulatory sandboxes can have three adverse effects: First, the internal validity of experimental legal regimes is limited because it is unclear whether the verified results are the direct result of the experimental intervention or other circumstances. The limited external validity of experimental legal regimes impedes the generalizability of the experiment. Second, experimental legal regimes that are not scientifically sound make a limited contribution to the advancement of evidence-based lawmaking and the rationalization of regulation. Third, methodological deficiencies may result in the violation of legal principles which require that experimental regulations follow objective, transparent, and predictable standards. I contribute to existing comparative public law and law and methods literature with an interdisciplinary framework which can help improve the design of experimental regulations and regulatory sandboxes. I draw on social science literature on the methods of field experiments to offer novel methodological insights for a more transparent and objective design of experimental regulations and regulatory sandboxes.

Facilitating innovation in FinTech: a review and research agenda

The purpose of this paper is to carry out content analyses on the existing literature to investigate the knowledge state of innovation facilitators adopted to promote financial innovation. In total, 56 papers were analysed using the NVivo software package. Three categories of innovation facilitators emerged from the literature capturing the perspective of regulators, incumbents and new entrants. Each identified instrument is defined and its processes and implications described. Many initiatives were led by regulators, revealing a regulatory strategy change from risk-based to opportunity-based regulation, with regulatory sandboxes being the most commonly adopted instrument. Incumbent-led innovation facilitators were also identified and typically took the form of corporate incubation models, co-working spaces, venture funds and innovation platforms to support financial institutions with partnerships, acquisitions or self-development. Lastly, the literature review revealed innovator-led instruments to support start-ups with raising capital. Based on our results, we discuss several important observations and propose avenues for future research capturing each of the identified perspectives. This paper contributes to incubation research and the financial innovation and FinTech literature streams.

ZusammenfassungAufgrund des Querschnittcharakters des Klimaschutzes werden für ein klimafreundliches Leben zahlreiche rechtliche Handlungsfelder relevant, vom Welthandelsrecht, über europäische Binnenmarktregeln oder den europäischen Emissionshandel bis zum Finanzverfassungsrecht, dem Wohnrecht oder dem Bau- und Raumordnungsrecht. In diesen Handlungsfeldern gesetzte rechtliche Maßnahmen stehen miteinander in Beziehung(en), die von einer Fülle von Koordinierungs-, Über- und Unterordnungsregeln geprägt ist bzw. sind und ihrerseits oft bestimmen, inwieweit und wie inhaltliche Gestaltungsentscheidungen geändert werden können. Gerade auf diese Wechselbezüge und ihre langfristig strukturprägende Wirkung legt der folgende Beitrag besonderes Augenmerk, wenn er den rechtlich geprägten Status quo für ein klimafreundliches Leben analysiert, notwendige strukturelle Veränderungen, ihre treibenden und hemmenden Faktoren sowie dabei relevante Akteur_innen aufzeigt und ausgewählte Reformanliegen diskutiert.
