Victims of child sexual abuse (CSA) in criminal proceedings face a range of stress factors. In response to this, collaboration between criminal justice and child protection professionals has been established both legally and informally, such as in the newly established Childhood Houses in Germany, which follow the model of the Scandinavian Barnahus to reduce stress and prevent revictimisation. This study intends to identify facilitating and inhibiting factors in the collaboration between the child protection and criminal justice systems in cases of CSA in Germany. Twenty‐eight qualitative interviews with experts from child protection, like counselling centre employees (n = 5), psychosocial court supporters (n = 5) and youth welfare office workers (n = 5), and the criminal justice system, like prosecutors (n = 5), police officers (n = 5) and attorneys (n = 3). The interviews are structured by a questionnaire and analysed using Kuckartz's method of qualitative content analysis (QCA). Findings show that key factors like information flow, assessments of collaboration partners, uncertainties about laws and actors' perspectives on reporting and networking determine the success or failure of interagency collaboration.

Çocuklar, çocuk olmasından dolayı özel olarak birtakım haklara sahiptir. Bu haklar farklı belgelerde ifade edilmekle birlikte, çocuk hakları konusunda en temel belge 20 Kasım 1989 tarihinde benimsenerek 14 Eylül 1990 tarihinde yürürlük kazanan "Çocuk Haklarına Dair Birleşmiş Milletler Sözleşmesi"dir. Çocuğun sağlıklı bir birey olarak gelişmesine odaklanan bu Sözleşme'de; ayrımcılık yasağı, yaşama ve gelişme, yararına öncelik tanıma, görüşleri dikkate alma ve katılım sağlama ilkeleri benimsenmektedir. Benimsenen ilkeler çerçevesinde toplumun hassas bir tarafını oluşturan çocukların olumsuzluklarla karşılaşmaması ve yaşam kalitesinin sağlanması adına, kamu yönetimi içinde ayrı örgütlenmelere ve politikalara ihtiyaç duyulmaktadır. Yukarıda ifade edilenler kapsamında bu çalışmada çocuklarla ilgili göstergelerde öne çıkan ülkelerde (Norveç, İsveç, Hollanda, İzlanda, Belçika ve Portekiz) nasıl bir örgütsel yapının geçerli olduğu ve hangi tür politikaların öne çıktığı inceleme konusu yapılmaktadır. Gerçekleştirilen incelemede çocuğa yönelik örgütlenmede, ülkelerin yönetim yapı ve kültürlerinin etkili olduğu, çocuk istismarını kapsayan çocuk koruma konusunda merkezi yönetimin öne çıktığı tespit edilmektedir. Yerel yönetimlerin ise merkezi yönetimi tamamlayacak şekilde çocuk koruma konusunda bazı görevler üstlenmekle birlikte daha çok eğitim, çocuk refahı ve sosyal hizmetler alanında öne çıktığı anlaşılmaktadır. Ayrıca ilgili ülkelerde çocuklar ağırlıklı olarak sağlık ve sosyal hizmetler sistemi kapsamında ele alınmakla birlikte aile odaklı (katılım ve ilişki kurma esasına dayalı) yaklaşımların da önem kazandığı görülmektedir.

The Barnahus model was launched in Iceland in 1998, and it subsequently spread to all the Nordic countries. It is an interagency, co-located model for working with cases of violence and abuse against children that addresses two vital concerns of welfare societies: to process cases through the legal system and to offer support and treatment to victims. The model is currently recommended as a best-practice model on the European leveland understood as representing a radical change in the organisational setup related to such cases. This paper analyses the diffusion and implementation of the model in two different contexts: the Nordic region and the wider European arena, where the model is currently promoted as an important innovation. Drawing on the concept of social innovation, we explore the structural and contextual conditions for the diffusion of the model and discuss its role in the ongoing transformation of welfare societies' response to children exposed to violence and abuse. We identify the policy-making means by which the model is promoted today and conclude that it can lead to manifold institutional changes, both radical and incremental, and both desired and undesired, depending on how the original idea is translated and adapted in different contexts.
