“…La doctrina del levantamiento del velo o Disregard of the Corporate Entity nace durante el siglo XIX en los tribunales estado unidenses (Lawton, 1923), que en la actualidad aplican esta figura para des-estimar la personalidad jurídica societaria bien bajo la fórmula "instrumentality doctrine", o bien con la doctrina del "alter ego" (Costantini, 2016). En la primera, se aplica el disregard si se comprueba el completo dominio político, financiero y administrativo de la sociedad por parte de los socios, lo cual permita concluir que la persona jurídica no tiene existencia propia, sumado esto a los actos defraudatorios que se ejecuten a través de la persona moral; en la segunda, se acude al levantamiento del velo cuando no es posible diferenciar la personalidad de la sociedad y de los socios debido al grado de unidad entre ambos, lo que generaría un resultado inequitativo para los terceros, si los actos se le endilgan exclusivamente a la sociedad (Tan et al, 2018;Rott, 2015;Cheng, 2011). Es así como otros Estados, entre ellos los latinoamericanos, han incorporado la figura del levantamiento del velo adecuándola a sus propios sistemas jurídicos, por lo que en los siguientes apartados se expone el estado actual de la discusión sobre esta figura en los países de la Alianza del Pacífico.…”
