PEMBERIAN NAFKAH MUT’AH DAN NAFKAH IDDAH PASCA PERCERAIAN (Studi Kasus Pengadilan Agama Majene Tahun 2017-2019)

Abstract

AbstrakPemberian nafkah mut’ah dan iddah diatur dengan jelas dalam Islam dan hukum nasional, namun besar biaya atau takaran pemberian nafkah tersebut belum ada regulasi khusus yang mengaturnya. Meski demikian, pengadilan dapat menentukan besar pemberian nafkah mut’ah dan nafkah iddah terhadap bekas isteri tersebut. Meskipun mantan isteri tidak menuntut hak mut’ah dan iddahnya dalam proses perceraian, hakim juga dapat mewajibkan mantan suami untuk membayar hak-hak tersebut. Jenis penelitian yang penyusun gunakan dalam skripsi ini adalah Field Research Kualitatif. Penelitian ini dilaksanakan di Pengadilan Agama Majene, Kabupaten Majene, Sulawesi Barat. Hasil penelitian dapat disimpulkan bahwa pemberian nafkah iddah dan nafkah mut’ah yang menjadi acuan dalam putusan perkara di Pengadilan Agama Majene adalah pasal 149 huruf a dan b Kompilasi Hukum Islam. Namun, aturan tersebut tidak mencantumkan besar biaya yang harus diberikan kepada isteri, maka besar jumlah uang atau barang tersebut ditentukan dengan didasarkan pada beberapa hal, yaitu kemampuan suami, sikap dan perilaku isteri selama dalam pernikahan, dan kesimpulan hakim berdasarkan penilaiannya dalam alur persidangan. Dalam pelaksanaannya, setelah pembacaan isi putusan, hakim memberi tahu suami agar membawa kewajibannya berupa nafkah iddah dan mut’ah pada saat pembacaan ikrar talak yang akan dilaksanakan di sidang selanjutnya.Kata Kunci: Nafkah iddah, nafkah mut’ah, dan perceraianAbstractThe provision of stipulations for mut'ah and iddah is clearly stipulated in Islam and national law, however, the amount of cost or amount of provision of such income has not yet been regulated specifically. However, the court can determine the amount of provision for the mut'ah and iddah expenses for the former wife. Although ex-wives do not claim their mut'ah and iddah rights in the divorce proceedings, judges can also oblige the ex-husband to pay for these rights. The type of research that compilers use in this thesis is Qualitative Field Research. This research was conducted at the Majene Religious Court, Majene Regency, West Sulawesi. The result of this research can be concluded that the provision of iddah income and earning mut'ah which is the reference in the case decision at the Majene Religious Court is article 149 letters a and b of the Compilation of Islamic Law. However, this regulation does not include the amount of money that must be given to the wife, so the amount of money or goods is determined based on several things, namely the husband's ability, the wife's attitude and behavior during marriage, and the judge's conclusion based on his assessment in the flow of the trial. In practice, after reading the contents of the verdict, the judge tells the husband to carry his obligations in the form of iddah and mut'ah livelihoods at the time of reading the divorce vows which will be carried out at the next trial.Keywords: Nafkah iddah, nafkah mut'ah, and divorce
