Penelitian ini bertujuan untuk menganalisis pola perilaku masyarakat tentang Eigenrichting dalam menanggapi suatu tindak pidana agar penyimpangan yang terjadi dari norma-norma sosial yang telah ditentukan dapat diperbaiki. Metode yang digunakan dalam penelitian ini adalah metode yuridis sosiologis dengan pendekatan kasus dan pendekatan konseptual. Lokasi penelitian bertempat di Desa Condongcatur, Depok, Sleman Yogyakarta. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan bahan sekunder. Bahan hukum primer berupa Kitab Undang – Undang Hukum Pidana (KUHP) dan bahan hukum sekunder berupa buku – buku hukum hukum pidana dan artikel di jurnal hukum. Data primer diperoleh dari wawancara dilakukan kepada masyarakat Desa Condong Catur, Pemerintah Desa Condong Catur dan Kepolisian Resor Kabupaten Sleman. Bahan hukum dan data primer yang terkumpul kemudian dianalisis dan disajikan secara deskriptif. Hasil penelitian menunjukkan bahwa perilaku yang ada di masyarakat mengenai Eigenrichting disebabkan karena tingginya egoisme masyarakat yang ditambah dengan adanya tindakan provokasi, ketidakpercayaan masyarakat terhadap penegak hukum. Kondisi tersebut berakibat pelaku tindak pidana dihakimi oleh massa. Kurangnya kerjasama antara penegak hukum dan perangkat desa dalam memberikan penyuluhan sadar hukum, menyebabkan sulitnya mengatasi tindakan Eigenrichting di Desa Condong Catur.

This article aims to study triggering factors to make vigilantism against perpetrators of jinayat sharia law violation in Aceh and analyze vigilantism based on the same law. This qualitative research uses literature study and field research as the approach methods. Relevant books, journals, newspapers, and laws and regulations are the primary references while the field study was conducted by interviewing respondents from Islamic criminal law enforcement officers in Aceh. This study found that the emotional attitude of the community, the attitude of joining in, the length of the trial process, the experience of freeing the perpetrators from punishment, and fights between the community and the perpetrators are factors that encourage people to take vigilante actions. The research also found that the punishment of being married off, being bathed in dirty water, as well as beating the accused before being tried in the court were acts that violated the procedures for the Aceh criminal law (Qanun Jinayat). It thus recommends further research related to the reflection of the implementation of Qanun Jinayat in Aceh for the sake of achieving the purpose beyond the qanun.

Introduction to the Problem: Indonesia is a constitutional state; therefore, all citizens must obey the applicable regulations. If someone commits a criminal act and is required to be brought to the court, evidence is an important thing to resolve the criminal case. A judge can determine whether the accused is guilty or not, one of the ways to determine is to consider the evidence. The law of evidence is known to have two types of evidence, namely direct evidence and indirect evidence (circumstantial evidence). Circumstantial evidence is a kind of evidence in which the relationship between the facts that occur and the available evidence can only be seen after drawing some certain conclusions. Circumstantial evidence can be very important if the other evidences are not sufficient to prove a criminal case in a court. However, the circumstantial evidences must be in accordance with the other evidences. Purpose/Objective of the Study: The purpose of this study is to understand the circumstantial evidence in the perspective of criminal law and how it is applied in criminal cases. Design/Methodology/Approach: The research method used in this study is a normative juridical research method, with the statutory approach and conceptual approach. The type of data used in this study is the secondary data using three legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials. Findings: Indirect evidence or Circumstantial evidence is one of the legal evidences according to Law Number 8 of 1981 concerning Criminal Procedure Law Article 188, namely the indication. However, Circumstantial Evidence is still rarely used by the system of criminal evidence in the courts in Indonesia because its validity is often questioned by the public.
