Overcoming legal barriers to coastal wetland restoration: lessons from Australia's Blue Carbon methodology

Abstract: Globally, there is a recognized need for widespread restoration of coastal wetlands. Despite this recognition, progress in many places has been slow, for reasons including legal and policy barriers. In Australia many of these legal barriers have been overcome in the development of the Carbon Credits (Carbon Farming Initiative ‐ Tidal Restoration of Blue Carbon Ecosystems) Methodology Determination 2022, which allows for certain coastal restoration projects to be accredited and ultimately receive Australian Car… Show more

“…The management and protection of all types of tidal wetlands are also aligned with the Reef 2050 long-term sustainability plan (Commonwealth of Australia 2021 ) and the State of Queensland Wetland Policy of no wetland loss (Wetland Info 2024 ). Strengthening the protection and restoration of all types of tidal wetlands requires addressing gaps in legislation for blue carbon projects (Bell‐James 2022 ). Classifying and mapping tidal wetlands are essential to any project with crucial management implications.…”

“…(P21): Despite the widespread need for wetland renewal globally, restoration efforts are often hampered by legal and policy barriers. In a policy article by Bell‐James (2023), the legal barriers such as lack of dedicated and fit for purpose policy, the uncertainty of land tenure, impacts on other landholders and carbon project‐specific legal issues in Australia are identified and described in detail. The streamlined solutions to navigate the legal permitting framework are needed across Australia.…”
