SciELO promotes open access and cooperative publication of scholarly journals, based mainly in Latin America, the Caribbean, Spain and Portugal. SciELO was created to offer solutions to increase the visibility of participating journals and facilitate free access to their full texts. This work aims to analyse the open access editorial policies implemented by the health sciences journals of the SciELO network (411 journals at the time of this study) in terms of authors’ rights, copyright issues, self-archiving policies and openness. From SciELO health sciences journals network, 92% of the 411 journals use a Creative Commons licence, 89% require transfer of author copyright and 14% apply author processing charges. According to the past SHERPA/RoMEO taxonomy of self-archiving policies, 8.5% of the journals were classified as white, 81.5% blue and 10% green. The openness of journals calculated through the Open Access Spectrum approach was higher than 60% in more than 80% of the total journals. Out of the 411 journals in SciELO portals, 380 have their own website. Discrepancies were found between licences stated in SciELO compared with the ones used in their websites, mainly due to the lack of declared licences in either of the two sources or because the licences did not match. The licences used on the websites and in SciELO were also compared with their corresponding records in the Directory of Open Access Journals and Crossref, and again the differences were narrowly related to the data supplier.

The Past, Present and Future of EU Copyright Flexibilities

Building on a wealth of studies on the strengths and pitfalls of EU harmonisation in the field of copyright exceptions and limitations, and on the state of the art of the copyright balance across the Union, the H2020 project reCreating Europe performed an unprecedented comparative mapping of EU and national legislative acts and case law regulating copyright “flexibilities” (exceptions and limitations; definition of protectable subject-matter; terms of protection; exhaustion; judicial doctrines such as fair balance and the horizontal effects of fundamental rights on copyright law; statutory licensing schemes; paying public domain et al.). On this basis, it produced national and comparative reports, grouped into 12 homogeneous categories of permitted uses. The study aimed at (a) assessing the degree of harmonisation across the EU and the impact of their territoriality and optional nature on the proper functioning of the system; (b) mapping which “uses” and “purposes” are balanced against copyright and with what results, both in the EU and in each Member State; and (c) identifying the regulatory gaps and enablers impacting on the proper functioning of copyright flexibilities across the Union. This article will provide an overview of the background, methodology (Section 2) and main results of the research, sketching the past and present of EU copyright flexibilities (Section 3). On this basis, it will provide general and specific recommendations for future reforms (Section 4).

By facilitating and accelerating access to knowledge, the digital revolution and the development of the internet in the 1990s constituted a “disruptive” innovation that radically transformed the models and practices of scientific information transmission. It opened the way to open access in science, a novel and promising solution that promotes the sharing of publications and data, and new modes of research assessment. The COVID-19 crisis and the spread of fake news on social networks have shown how necessary it has become to provide scientific information that is controlled by the community and freely accessible to citizens. This chapter will focus on the processes that underpin the production of Open Science by examining the development of open access scholarly publishing in Europe, particularly for the social sciences and humanities.
