Die Finanzverfassung des Grundgesetzes widmet sich der Steuer mit besonderer Aufmerksamkeit. Wegen ihrer Gegenleistungsunabhängigkeit und Voraussetzungslosigkeit sichert diese Zukunftsoffenheit und Unabhängigkeit der Staatsfinanzierung 1 . Die Steuer ist indes nicht exklusives Instrument zur Finanzierung staatlicher Aufgaben. In der offenen Rahmenordnung 2 der Finanzverfassung finden auch nichtsteuerliche Abgaben ihren Raum. Als Instrumente, derer sich der Sachgesetzgeber bedienen kann 3 , sind sie für den Verwaltungsstaat der Normalfall, mögen sie auch im Steuerstaat als Krisenphänomen begriffen werden 4 .
