O Marco Legal da Primeira Infância (Lei nº 13.257/2016) e a Educação Infantil no Brasil

Abstract

The Marco Legal da Primeira Infância (MLPI) is Law nº 13.257/2016, recently enacted aimed at children aged between zero and six years. The present research seeks to analyze the process of processing and approval of the MLPI and to what extent it contributes to the expansion of the right to education of young children in Brazil. The research, with a qualitative approach, included documental analysis and bibliographic research. Considering the global and national scenario regarding legislation and rights related to children in this age group, the research brings the context of International Human Rights Law (HR) and the rights of young children, from the peculiar Brazilian historical and political context, as well as the political influence of international organizations on Early Childhood Education in Brazil. The main results of the research are: the obligation for signatory countries of the International Human Rights Treaties to carry out policies aimed at young children; private corporate agents as the main influencers in the enactment of the MLPI, being also those who lead the implementation of the law through speeches that overvalue the discoveries of neuroscience to the detriment of other areas of knowledge; with regard to the right to Early Childhood Education, the MLPI has not made any progress, given that national legislation already prescribes specific policies for these children through the expansion of daycare centers and preschools.
