O duplo grau de jurisdição, a colegialidade e seus vieses cognitivos

Abstract

A partir dos estudos de Daniel Kahneman e Amos Tversky a respeito do processo decisório humano no campo da psicologia comportamental, o artigo pretende analisar qual o impacto dos vieses cognitivos e das heurísticas sobre os julgamentos judiciais realizados por órgãos colegiados. Não é objetivo deste artigo comprovar empiricamente os vieses cognitivos – o que poderá ser objeto de estudos futuros – mas sim cogitar de que maneira os vieses podem ser amplificados em órgãos colegiados. Parte-se da hipótese de que a colegialidade só será eficiente na correção de vieses cognitivos caso esteja disposta a se livrar de seus próprios processos heurísticos e enviesadores.
