I denne artikkelen fokuserer jeg på kjerneelementet «Kunne ta andres perspektiv» som del av de nye kjerneelementene i fagene KRLE og Religion og etikk (RE). Jeg reflekterer over hvordan kritiske raseperspektiver og en fenomenologisk tilnærming kan utfordre og utvikle tankene og perspektivene som presenteres i kjerneelementet. Artikkelen gir en kort innføring i fenomenologi, med særlig vekt på Sara Ahmeds skeive fenomenologi, samt en begrunnelse for hvorfor fenomenologi er nyttig for KRLE- og RE-lærere. Den fenomenologiske undersøkelsen fordrer en forståelse av og innsikt i norsk kolonihistorie, og jeg gir overblikk over noen historiske linjer og hva dette innebærer i dag. Bevisstheten om denne historiske arven vil implementeres i en fenomenologisk undersøkelse av de nye kjerneelementene i KRLE og RE. Artikkelen viser hvordan de nye kjerneelementene er forankret i et sentralisert, hvitt perspektiv og hvilke utfordringer dette stiller lærere, elever og skolen overfor, og demonstrerer hvordan desentraliserte perspektiver kan bidra til å motvirke diskriminering og rasisme i KRLE- og RE-faget. The aim of the article is to propose and defend a distinctively political reading of the European Convention of Human Rights. Drawing on a range of different sources, my core claim is that realistically construed considerations of political legitimacy, stemming from the institutional context within which ECtHR judges operate, can explain and justify a morally non-ideal understanding of Convention rights on the part of the Court. I call the kind of non-ideal reading of the ECHR that I defend ‘political’ because it results from distinctive concerns regarding the Court’s legitimacy in a wider context marked by the circumstances of politics, broadly understood. These concerns depend on apprehending the ECHR as a distinctive institutional-cum-legal regime or system whose stability has political underpinnings. Tackling them requires resorting to some form of political judgment aimed at working out how various normative parameters, including legitimacy and stability, interact with a morally ideal (or ‘first-best’) understanding of any given ECHR right.

Faced with widespread prejudice and discrimination, European Muslims are increasingly resorting to the European Court of Human Rights as a last-ditch strategy to transform state policies toward minority faiths. While the Court has a mandate to protect religious freedom and equality, the conservative and sometimes biased way in which it has interpreted these concepts has enabled the persistence of stark asymmetries in the legal and social statuses of different religions. Using an analysis of relevant cases, this article seeks to highlight the judicial processes that currently sustain Muslim subordination and pinpoint specific reforms that could reverse the trend.
