Mutação constitucional: origem, (des)construção e justificação

Abstract: means nothing in regards to its appraisal. The legitimation of constitutional mutation -one of the possible paths in handling the concept -represents an independent step, which acquires an interesting facet through constitutional theories that value the expression of popular sovereignty, often to the detriment of formalistic positivism. Whether this perspective is eventually adopted or not, the main goal is to establish new premises in the debate regarding constitutional mutation.
