Used Edward III's policy theory, this study aims to analyze Communication (X1), Resources (X2), Bureaucracy (X3), and Disposition (X4) affect the performance of public policy implementation in the placement and protection of Indonesian Migrant Workers from NTT impact on the transmission of sexually transmitted infections HIV AIDS in NTT (Y). Conducted in Kupang City by taking PPTKIS Citra Bina Tenaga Kerja (CBTM) as a recruiting, training and sending agent. Respondents were 93 people from 122 populations, who departed in 2016-2017 and returned in 2019-2020. Research sample is purposive and snowball sampling. The results show that implementation performance (Y) has not gone well. Statistical analysis used SPSS 26: 1) X1 has a parameter coefficient (original Sample 0.280) against (Y), where the effect was positive and significant (t = 2.946>t-table 1.662); 2) X2 has a parameter coefficient (original sample -0.153) against (Y), where the effect was positive and significant (t = -1.629<t-table 1.662 ); 3) X3 has a parameter coefficient (original sample 0.052) against (Y), where the effect was positive and significant (t = 1.001 <t-table 1.662); 4) X4 has the lowest parameter coefficient (original sample 0.116) (Y), where the effect was positive and significant (t = 2.267>t-table 1.662). The strongest variable influencing policy implementation is communication.

Perdagangan orang merupakan tindakan yang bertentangan dengan harkat dan martabat manusia. Perdagangan orang semakin merajalela hingga ke daerah salah satunya adalah daerah Nusa Tenggara Timur. Pelaku perdagangan orang menggunakan berbagai macam modus operandi untuk mendapatkan korban. Perdagangan orang saat ini sangat meresahkan banyak anggota masyarakat karena bertentangan dengan Hak Asasi Manusia sehingga pemerintah harus segera memberantas kejahatan ini sebagaimana yang diatur dalam Undang-undang Nomor 21 Tahun 2007 Tentang Pemberantasan Tindak Pidana Perdagangan Orang. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimanakah modus operandi tindak pidana perdagangan orang khususnya anak di wilayah hokum Kepolisian Daerah (POLDA) NTT? (2) Bagaimanakah upaya penanggulangan tindak pidana perdagangan orang khususnya anak di wilayah hokum Kepolisian Daerah (POLDA) NTT? (3) Apakah hambatan-hambatan dalam menanggulangi tindak pidana perdagangan orang khususnya anak di wilayah hukum Kepolisian Daerah (POLDA) NTT? Penelitian ini merupakan penelitian hukum empiris yang dilaksanakan di Kepolisian Daerah Nusa Tenggara Timur dan LAPAS Kelas IIA Kupang. Teknik pengumpulan data menggunakan teknik wawancara dan studi kepustakaan. Data yang digunakan adalah data primer dan data sekunder. Hasil pengolahan data tersebut dianalisis secara deskriptif kualitatif. Berdasarkan hasil penelitian dan pembahasan maka dapat diketahui: (1) Modus operandi yg digunakan pelaku untuk mendapatkan korban yaitu pelaku mengiming-iming korban dengan gaji yang tinggi, pemalsuan dokumen, penculikan korban, penjeratan hutang, perekrutan TKI ke luar negeri secara non procedural/illegal. (2) Upaya penanggulangan tindak pidana perdagangan orang yang dilakukan pihak Kepolisian Daerah Nusa Tenggara Timur melalui upaya preemtif, upaya preventif dan upaya represif. (3) Hambatan yang dihadapi pihak Kepolisian dalam menanggulangi tindak pidana perdagangan orang yaitu kebanyakan para pelaku tindak pidana perdagangan orang berada di luar negeri, para pelaku melakukan tindakannya secara sembunyi dan perseorangan sehingga sulit dideteksi, ketika anak sudah menjadi korban baru orang tua mulai melaporkan kasus tersebut dan ada sebagian orang tua yang mengijinkan anaknya untuk dipekerjakan secara illegal.

Trafficking in persons is a cross-border crime which injures human dignity. The mode of trafficking in persons is to take advantage of the economic conditions of potential victims by luring them a better job. This research will discuss the profile of victims of trafficking in persons, gender analysis in human trafficking, and international policies in victim protection that are gender equality oriented. This research is a normative juridical study examining the analysis of international legal instruments, laws and court decisions. The research was conducted using the statute approach, legal concepts and the concept of gender. The victims of trafficking in persons are dominated by women, although it does not rule out the possibility that men can also be the victims. Women are considered as commodities that can provide benefits because they can be bought and sold to do work without requiring high education, and even provide sexual services. The perpetrators of the criminal network carry out the recruitment of potential victims by involving the householder of the potential victim, in this case the husband or father of the potential victim. This condition cannot be separated from the deep rooted patriarchal culture in the society, in which the men play a role as the decision makers in the family. Power relations play an important role in analyzing this crime of trafficking in persons. Efforts to combat trafficking in persons are carried out within the framework of a gender-equitable policy. However, the existing legal instruments have not addressed the fundamental problems of trafficking in women. Reconstruction of the legal culture of society is very important in protecting women from various forms of violence.
