The younger generation is being targeted as the threat of drug seizures rises in Indonesia. Narcotics are substances or drugs that can alter consciousness, cause loss of feeling, lessen or eliminate pain, and cause dependence. They can be derived from plants or non-plant sources and synthetic or semi-synthetic. As a result, drug users who commit crimes need rehabilitation in order to overcome their drug use. For those who commit drug crimes, rehabilitation is a form of punishment with the objective of healing or treatment. However, in practice, judges frequently favor to sentence drug offenders to prison terms and fines, even though offenders can also be sent to rehabilitation. This empirical normative legal study uses primary and secondary data as its data sources and fieldwork and library research as its data collection methods. According to the study's findings, the judge's factors in establishing that the defendant's actions met the requirements of Article 127, paragraph 1, letter an of Law Number 35 of 2009 Concerning Narcotics were taken into consideration in proving the defendant's actions (Narcotics Law). One example is the decision in the drug crime case at the Special Class II Gedong Tataan District Court, which is based on the accuracy of the evidence and the legal facts presented during the trial and the fulfillment of the elements of each of these crimes. It was argued that it was appropriate for the defendants to receive prison sentences and fines rather than engage in medical or social rehabilitation because their status as drug addicts or abuse victims had not been established.

Convicted narcotics abusers after being imprisoned comparing the imposition of punishment with other convicts will feel that their detention period is much longer than that of other convicts even though they have the same criminal offense. Based on these legal issues, the problems to be discussed are the factors causing disparity in judges' decisions against narcotics abusers and the basis for judges' considerations in imposing different decisions on narcotics abusers based on Decision Number 156/Pid.Sus/2021/PN.Met, Decision Number 39/Pid.Sus/2020/PN.Met and Decision Number 134/Pid.Sus/2021. The methods used in this research are normative juridical and empirical juridical approaches using primary and secondary data. Data collection using the literature study method and supported by the results of research interviews. Based on the results of the study, the factors causing disparity are that there are no guidelines for judges in deciding criminal acts of narcotics abuse, then the judge factor is due to the judge having very broad freedom so that it gives the judge discretion to impose a sentence. Juridically, the judge's consideration is based on legal facts revealed in the trial, while non-juridically is the judge's judgment outside of the revealed legal facts. Judges in making legal considerations must be able to explicit the decision and in the consideration of the judge is expected that the judge can strive for drug abusers to be rehabilitated and can humanize humans.

Tujuan dari artikel ini untuk mengetahui konsepsi penjatuhan pidana terhadap anak yang di Indonesia. Pada masa lalu pemidanaan terhadap anak sama dengan pemidanaan terhadap orang dewasa. Hal itu menyebabkan kondisi psikologis anak mulai dari penyidikan, penyelidikan dan pengadilan menjadi terganggu karena kerap diintimidasi oleh aparat hukum. Berdasarkan kondisi tersebut maka lahirlah Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Salah satu pembaharuan yang ada dalam Undang-Undang Sistem Peradilan Pidana Anak diwajibkan penyelesaian perkara pidana anak dengan jalan diversi. Faktanya masih banyak kasus perkara pidana anak yang masih tidak memakai diversi sebagai jalan keluar kasus pidana anak. Penelitian ini adalah penelitian hukum normatif, dimana berfokus pada Undang-undang dan penelitian kepustakaan, Metode pengumpulan data merupakan proses atau cara yang digunakan untuk memecahkan suatu masalah yang akan diteliti. dalam penelitian ini, penyusunan menggunakan analisis kualitatif. Berdasarkan hasil penelitian bahwa konsepsi penjatuhan pidana terhadap anak di Indonesia adalah berbeda dengan penjatuhan pidana kepada orang dewasa. Anak-anak diberikan pemidanaan yang seringan mungkin dan setengah dari penjatuhan pidana pelaku tindak pidana dewasa, dimana ada diversi didalam aturan yang berlaku di Indonesia.
