Legal Standing Pemohon Terkait Pengajuan Judicial Review Di Mahkamah Konstitusi

Abstract

This study aims to determine the meaning of the qualifications of legal standing of the applicant in the judicial review of the Law against the 1945 Constitution of the Republic of Indonesia. The petition argued by the applicant must fulfill the elements related to the legal standing of the applicant in the Judicial Review in the Constitutional Court so that it can prove that the applicable law has caused a loss of constitutional rights. The research method uses normative legal research. Testing the constitutionality of the norms of the Law against the 1945 Constitution of the Republic of Indonesia, the applicants must pay careful attention to the qualifications of legal standing against the enactment of a law that is contrary to the 1945 Constitution of theRepublic of Indonesia, the applicants must also pay attention to the aspects of the constitutionality of the norms and the implementation of the norms of a law. The Constitutional Court has the authority to examine the constitutionality of the norms of a law. It does not examine the implementation of a legal norm, which is the authority of the Supreme Court.
