ÚvodRoky 2012 a 2013 jsou celoevropsky ve znamení snahy států vybrat více peněz na daních, v řadě zemí došlo ke zvýšení sazeb daně z příjmů fyzických osob, sazeb daně z příjmů právnických osob nebo sazeb daně z přidané hodnoty. V České republice se v poslední době dostaly do hledáčku státní správy i podnikatelé a živnostníci. Důvodem pro to je vyhodnocení výběru daně z příjmů od těchto osob, který za poslední roky dramaticky klesl. Boj proti tomuto poklesu se zobrazil do zvýšení daňové zátěže těchto osob od roku 2013. Některé souvislosti a dopady na konkrétní profese rozebírá následující text.Cílem článku je rozebrat dopady novelizace zákona o daních z příjmů pro rok 2013 pro určité fyzické osoby dle jejich profesí a výše zdanitelných příjmů a to z důvodu, že Česká republika provedla razantní krok směřující k výběru daní od podnikajících fyzických osob
Rovná daňListina základních práv a svobod ve svém článku 11, odst. 5 stanoví, že daně a poplatky lze ukládat jen na základě zákona. Žádný zákon v České republice nedefinuje pojem "daň", takže musíme sáhnout do odborné literatury. Podle Širokého aj. (2008) je daň povinnou, zákonem předem stanovenou částkou, kterou se odčerpává na nenávratném principu část nominálního důchodu ekonomického subjektu. Daněmi se odnímají příjmy soukromého sektoru, aby se jejich výnosy mohly stát příjmem veřejného rozpočtu. Daň tak představuje transfer finančních prostředků.Česká republika se nechala inspirovat některými zeměmi v Evropské unii a od roku 2008 zavedla "rovnou daň". Koncept proporcionální, jednotné daně "flat tax" navrhli američtí ekonomové R. Hall a A. Rabushka v roce 1981. Mimo nezdanitelné minimum v pevné výši, jehož existenci ospravedlňují životně nezbytné potřeby, obsahuje rovná daň osobní ještě základní sociální odčitatelnou položku na vyživovanou osobu -dítě, manželku (představme si to tak, že první úleva je určena pro osoby v domácnosti výdělečně činné, druhé pro výdělečně nečinné). Ostatní daňové úlevy typu výdajů na dobročinnost, úroků z hypoték a daňové zápočty jsou nepřípustné (Čížík, 2008).Podle Láchové (2007)
