Instrumenty prawne obstrukcji parlamentarnej I.Odnalezienie właściwej koncepcji balansu pomiędzy swobodnym działaniem większości parlamentarnej a prawami chroniącym mniejszość stanowi jeden z najbardziej doniosłych problemów zarówno przy konstruowaniu ustroju rodzącego się państwa, jak i podczas jego wieloletniego funkcjonowania. Każde z państw demokratycznych, czy to w Europie, czy na świecie, staje przed powszechnym wyzwaniem parlamentaryzmu, by zapewnić konstytucyjne ramy z jednej strony ochronie interesów opozycji, a zarazem z drugiej umożliwić demokratycznie obranej większości możliwość sprawnego funkcjonowania i ustanowić bariery przeciw potencjalnemu paraliżowi procesu decyzyjnego struktur państwowych.Niewątpliwie dla odzwierciedlenia wagi wyborów powszechnych, jak i realizowania zasad demokratycznego państwa prawa, opozycja winna mieć swobodę w posługiwaniu się szeregiem instrumentów prawnych, które pozwalają na choćby częściową ingerencję w proces decyzyjny danego organu ustawodawczego.
