An Emerging Key Concept in European Constitutional Law: Sustainability

Sustainability, as comp ared to the rule of law, human rights, sovereignty or democracy, is a relatively new constitutional key concept. It is mentioned explicitly more and more in constitutional discourses, and – even more importantly – it helps to reconstruct a number of current constitutional debates under one conceptual umbrella. Sustainability comprises different responses to long term social challenges which cannot efficiently be responded to via democratic mechanisms. Democratic mechanisms are based on election terms and which are, consequently, structurally short-sighted. By ‘European constitutional law’, I mean in this paper both the primary law of the EU and domestic constitutional documents. In the present paper is am first going to sketch the nature and the types of the sustainability challenges that contemporary societies face, with a special focus on Europe (environmental, demographic and financial). In the main part of the paper, I am going to show possible constitutional responses to these challenges. Finally, I will summarise the main argument of the paper which is a suggestion to set up an economic constitutional court consisting of economists with the power to annul laws if these contradict the principles of sustainability.

Abstract The barriers of rotation of olefin ligands in (OC)3 LL′W(olefin) complexes, L - P(OMe)3 , L′ = P(OMe)3 or P(OEt)3 , olefin = ethylene, methylmaleate, methylfumarate, methylacrylate (1-4) have been determined from D-NMR measurements. The preferred olefin orientation has been deduced from an X-ray analysis of the tricarbonyl-triethylphosphite-trimethylphosphite-methyl-maleatetungsten compound 2. The influence of steric and electronic factors on the rotational process has been discussed by use of EHT-calculations.

(OC-6-32)-W(CO)3[(CH3)2PC2H4P(CH3)2] (olefin) complexes (9-14) were prepared photochemically from W(CO)4[(CH3)2PC2H4P(CH3)2](l) via W(CO)3[(CH3)2PC2H4P(CH3)2]- (THF) (2) and the electron poor olefins dimethyl inalonate(3), fumarate (4), inothylfumarate (5), fluorofumarato (6), chlorofumarato (7) and bromofumarate (8). The stereochemistry of 9-14 was elucidated by IR and NMR spectroscopy. The hindered rotations of the olefin ligands in 9-14 were studied by D-NMR spectroscopy. 11-14 form two diastereomeric isomers when the olefin rotation is freezed. The spectroscopic behaviour of the dimethyl fumarato complex 10 gives unambiguous proof for the rotation of the olefin ligand around the metal-olefin-bond. Alternative motions are ruled out.
