Exploring the future of the institutional landscape of the oceans beyond national jurisdiction

Abstract: A comprehensive regime for biodiversity in marine areas beyond national jurisdiction (ABNJ) is currently being negotiated at an intergovernmental conference convened by the United Nations. One of the aspects of the negotiations concerns the institutional arrangements of the treaty that is to be developed. Many activities in ABNJ currently are being regulated at the sectoral and/or regional level, raising the question how the institutional arrangements of the treaty are to interact with these existing framework… Show more

“…Currently, however, there is no official global body in charge of the identification and management of area-based management tools on the High Seas (Van Dover et al, 2016;Becker-Weinberg, 2017;De Santo, 2018;Elferink, 2019). As a result, such conservation and sustainable use measures are currently implemented within a fragmented framework by regional and sectoral organizations with different management competences (See Figure 1) (Drankier, 2012;Durussel et al, 2017).…”

“…A key question of the negotiations is how any proposed institutional arrangements of the ILBI (including institutional structures, policies, systems and processes for decision making, funding mechanisms and information exchange) will interact with existing sectoral and regional institutional arrangements that are already governing many activities in ABNJ [ 21 ]. At the third negotiating session [ 14 ], there was general support for the establishment of a conference of the parties, a scientific and technical body and a secretariat and for setting out their main functions in the ILBI but there is no agreement yet on their functions [V.13–15].…”

“…16 The ILBI will thus likely overlap with the existing global and regional regimes for BBNJ, which means that "a major concern in negotiating the ILBI is the avoidance of the potential for fragmentation of the law and decision-making procedures." 17 Bioprospecting, which can be defined as "the process of identifying unique characteristics of marine organisms for the purpose of developing them into commercially valuable products," 18 is already subject to a complicated regulatory setting in the Southern Ocean. 19 The reason for this is that not only the different instruments of the ATS, but also the LOSC and the CBD are relevant for its regulation in the Southern Ocean.…”
