Executory Contracts, Ipso Facto Clauses and Licensing Agreements in Cross‐Border Insolvencies

Abstract: Executory contracts raise difficult substantive and procedural questions under insolvency law. This essay tries to point out two prominent phenomena of substantive law concerning the treatment of executory contracts.
