Evaluating the jurisprudential wisdom of Judge C.G Weeramantry at International Court of Justice as the echoing voice of Global South

Abstract

This paper seeks to examine the contribution made by Sri Lankan judge C.G Weeramantry in International Court of Justice during his tenure as a judge from a perspective of Global South. Contrary to the political realism which appeared to be a predominant factor in ICJ, Judge Weeramantry made a great contribution in making a voice for third world countries. In particular, the universalist approach he maintained while delivering his judgements and advisory opinions at International Court of Justice aptly indicated the need for a fair space in international law. This paper will demonstrate the overarching significance of Judge Weeramantry’s jurisprudence in several chosen ICJ cases and advisory opinions as the alternative voice in a place where international law was dominated by power politics.
