Does the Controversy Matter? Comparing the Causal Determinants of the Adoption of Controversial and Noncontroversial Rape Law Reforms

Abstract: Do the causal determinants of legal change differ for controversial and noncontroversial laws? Using rape law reforms as an example of legal change, I answer this question via a longitudinal examination of the intrastate characteristics and interstate processes that affect the adoption of both controversial and noncontroversial rape law reforms. The results show that the adoption of partial reforms significantly decreases a state's likelihood of passing a stronger version of the reform only for controversial r… Show more

“…Designing and implementing effective law reform is challenging, not least because the law reform process is variable, non-linear and involves a changing array of actors and stakeholders (Easteal, 1998). Law reform can be particularly difficult when addressing socially or culturally sensitive topics such as sexual offences, family violence, reproductive and sexual choices, and illicit drug use (Freiberg & Carson, 2010; Kennedy & Easteal, 2011; McMahon-Howard, 2011; Neave, 1988; Powell et al., 2013). In particular, sexual offences legislation has received significant law reform attention in recent years, particularly in relation to competing demands to improve confidence in the criminal justice process, improve the experiences of victim/survivors and protect due process for complainants.…”

“…Walby (2009) found that those countries that had a higher proportion of women among members of parliament (MPs) had a lower rate of homicide of women than when there were smaller proportions of women. Indeed, there are further studies finding positive associations between the extent of feminist politics and the reform of laws concerning rape (Frank et al, 2009;McMahon-Howard, 2011). The process of Europeanisation has contributed to the development of national-level policies to address rape and other forms of gender-based violence (Krizsán and Popa, 2010).…”
