The digital economy has radically changed the way services and products are developed and deployed. Digital information and communication technology connects increasing numbers of people, organisations, and other systems. The interconnectedness of services and products in an organisation and the outside world drives complexity. These interactions include humans interacting in social networks with one another, the technology, and the environment. Therefore, systems thinking approaches are required to help develop these systems and resolve the complex problems encountered in this space. This paper proposes a systems thinking framework to address the challenges of the digital economy from a sociotechnical perspective, based on an exploratory literature review. This will serve as a guideline for implementing various systems thinking tools to support a successful digital transformation. The digitalization of societies, accelerated by the COVID-19 pandemic, is an unstoppable process. This paper seeks to answer the question: what post-COVID-19 digital competences are needed for a sustainable society? It also aims to analyze the digitalization processes in education for shaping a sustainable digital society. A bibliographic search was performed on some of the most relevant international databases of scientific literature and the selected documents were analyzed through a content analysis. It is concluded that digital education has experienced a strong increase, reinforced by COVID-19, shaping the digital presence in all dimensions of life. However, it is not sufficient to assume that the new generations are naturally engaged in and can master digital social sustainability. The results demonstrate the importance of literacy and the unavoidable promotion of sustainability in a digital society. However, this digitalization of the educational process poses several challenges: it requires both software and hardware conditions, as well as digital literacy as a result of a complex of literacies. It also implies that teachers and students change their standpoints and practices with the attainment of new teaching and learning competences in order to fight the digital divide and to foster the widest possible social inclusion for the promotion of sustainable society—digitainability.

The dynamic development of the global economy and trade is additionally connected with the exponential development of digital technologies. The progressive development of information technologies, as a segment of the information society, has influenced the changes in the traditional ways of performing economic activities. Global trends in the digital economy, which has equal importance in the domestic and foreign economic markets, require that countries adapt their legislation to the needs of the new way of functioning of the economy and economic relations in general. When it comes to digital economy, it is viewed on a par with the information society. The necessity of the existence and development of the digital economy is cohesively connected with the state of the information society in one economic space. In this domain, the digital economy relies on the degree of development of the information society of a market, since its progressive development is previously determined by the degree of development of the information society itself. Today, this parallel has been scientifically and professionally verified, and the development of the digital economy of a society is interdependent with the development of the information society. Given that this is a socio-economic phenomenon, the level of development of the information society, and consequently the digital economy, is in one segment pre-determined by the legislative framework governing the area. The subject of the research is the analysis of relevant issues in the context of the connection between the digital economy and the information society on the one hand and the legislative framework that regulates particular issues of interest in this area. The aim of the research is to define the application of the approach to the legal regulation of relevant issues in the field of digital economy from the aspect of the internal law of the Republic of Serbia.
