Book of Sentences of Appeal Court in Prague This paper focuses on fundamental historical source important for recognition of judicial praxis in the early modern era: Books of Sentences of Appeal Court in Prag. This court was established in 1548 and since that year were the sentences taped down to books of sentences in two language rows: czech and german. The study analyzes both the outside of the source (font, language, graphical form of the decision) and, above all, its internal structure. At the same time, some particular requirements (which included each decision) are identified, and then the possibilities of their interpretation in individual and in context are presented. The paper is based on the knowledge of dozens of ortel books across the 250 year period for which the study is written. Its contribution lies mainly in describing some general elements that touch this source. The thesis can also serve as a basis for quantitative and qualitative research in the field of early modern justice.

The present study focuses on the question of the specialization of the councils of the Court of Appeal at the end of the 17th century, i.e. whether individual cases were assigned to judges according to their professional or other specialization. First of all, the paper defines the very notion of specialization as a phenomenon that can be perceived in terms of geography, language, subject matter and personnel. The initial sources are the minutes of the Court of Appeal, which survive for the end of the seventeenth century and from which it is possible to see which councils were assigned which cases to handle. On the basis of these protocols, the author conducts a quantitative and qualitative analysis of the collected sources and concludes that all four types of specialization were applied to a greater or lesser extent in the Court of Appeal, but that they were never fully implemented. Although this is an examination of a phenomenon that has not yet received the attention of the professional community, the results so far appear to be fruitful and may shed light on the internal workings of some courts, as it is a generally actionable phenomenon.

Pražský apelační soud (Appellationsgericht) byl založen nařízením Ferdinanda I. roku 1548. Z počátku se pražští soudci zabývali především rozsudky civilně - správními a teprve od konce 17. století pak i rozsudky kriminálními. Právní naučení se několikrát týkala také Slavkova u Brna. V některých letech, jako např. 1723 a 1732, rozhodovali slavkovské soudní verdikty i opakovaně. Podle rozhodnutí pražských soudců převažoval v první polovině 18. století u odsouzených ze Slavkova trest smrti jako vůbec nejčastější rozsudek. Podle záznamů pražského apelačního soudu byla nejčastěji souzeným trestným činem ve Slavkově vražda (1710, 1711), vražda dítěte nebo plodu (dva případy 1723), krádež (1731, 1732), překupnictví (dva případy 1732), falzifikátorství (1702), kacířství (1706) a prodej kradených věcí (1725). Část odsouzených byla z židovské komunity (1725, 1731, 1732).
