Este trabajo presenta un análisis legal en España sobre el delito conocido como cohecho electoral, el cual no requiere la condición de "autoridad o funcionario público". Este delito está tipificado en el artículo 146.1.a) de la Ley Orgánica 5/1985, del Régimen Electoral (LOREG). Específicamente, se examina la manipulación de los procesos electorales a través de la compra de votos por correo, una práctica que constituye una violación del derecho fundamental de participación establecido en el artículo 23 de la Constitución española. Se argumenta que esto supone la negación del legítimo derecho de los electores a decidir libremente y a ser elegidos en condiciones de igualdad, evocando las prácticas de los caciques durante la Restauración. Por lo tanto, se plantea la hipótesis de que la preservación del poder es el factor subyacente que motiva la comisión de este delito, reflejando así el mismo origen del antiguo caciquismo español.
