Drawing on research carried out for the Scottish Government in 2014, this article explores how people experience sectarianism in Scotland today. For some, sectarianism is manifestly part of their everyday experience, but for others it is almost invisible in their social world. The article sets out a metaphor of sectarianism experienced like a cobweb in Scotland; running strongly down the generations and across masculine culture particularly, but experienced quite differently by different people depending on their social relationships. Using the examples of song and marching, the article suggests that sectarian prejudice should be conceived of as much as a cultural phenomenon as in social and legal terms. A multidisciplinary and intergenerational approach to tackling sectarian prejudice would help emphasise its cultural and relational construction. Much can also be learned from examining the broader research on prejudice worldwide, rather than treating Scottish sectarianism as if it is a unique and inexplicable quality of the national character.

Perkembangan teknologi dan informatika berdampak pada kebebasan berpendapat dan penyampaian informasi di Indonesia seringkali meresahkan individu maupun kelompok seperti Suku, Agama, Ras, Antar Golongan. Tujuan penelitian ini membahas kebijakan formulasi hukum pidana dalam menanggulangi tindak pidana penyebaran ujaran kebencian (hate speech) di Indonesia masa saat ini dan masa yang akan datang. Kebijakan formulasi hukum pidana penyebaran ujaran kebencian dalam KUHP; UU Nomor 1 Tahun 1946; UU Nomor 1/PNPS Tahun 1965; UU Nomor 40 Tahun 1999; UU Nomor 32 Tahun 2002; UU Nomor 40 Tahun 2008; UU Nomor 19 Tahun 2016 masih banyak terdapat kelemahan yuridis dan dari formulasinya belum sistemik, dan belum mampu maksimal dalam menaggulangi kejahatan penyebaran ujaran kebencian melalui sarana sistem hukum pidana. Pada konsep KUHP yang sedang digagas telah mengakomodir seluruh kekurangan yang terdapat dalam peraturan perundang-undangan saat ini sebagai penanggulangan ujaran kebencian.

Despite high levels of societal homophobia, Western Balkan countries have recently passed laws proscribing anti-LGBT violence. The laws, however, are rarely used, as these countries report few or no recorded cases. The question is: Why do Western Balkan countries legislate against homophobia, but then fail to operationalize that legislation? Hate studies, still over-focused on the West, do not provide the answer. The aim of this paper is to offer a possible explanation based on a combination of secondary data provided by the OSCE and primary research undertaken by the author. Using the theory of Europeanization as an explanatory frame, the paper argues that hate crime laws are enacted as part of the democratization process, with the support of the OSCE and NGOs, and under EU influence. As this is done before favourable sentiments are assured, insufficient resources are put into the policing and monitoring of hate crime.
