Competition Law Around the World From 1889 to 2010: The Competition Law Index

Abstract: Competition laws have become a mainstay of regulation in market economies today. At the same time, past efforts to study the drivers or effects of these laws have been hampered by the lack of systematic measures of these laws across a wide range of years or countries. In this paper, we draw on new data on the evolution of competition laws to create a novel Competition Law Index (the "CLI") that measures the stringency of competition regulation from 1889 to 2010. We then employ the CLI to examine trends in the … Show more

“…We focus on the OECD and HD scores because they (i) are well regarded in the literature, (ii) are among the most recent publicly available scores, (iii) cover a broad sample of countries, and (iv) separate the EU from the member states, a critical condition for testing our model. Among the remaining scores, the most prominent are those ofVoigt (2009);Buccirossi et al (2011);Bradford and Chilton (2018). However, neitherVoigt (2009) norBuccirossi et al (2011) provide complete scores for the EU(Buccirossi et al (2011) score DG Comp only in a subset of dimensions andVoigt (2009) provides no scores) Bradford and Chilton (2018).…”

“…Taken together, these variables provide a detailed picture of competition regimes from countries’ first adoption of a competition law through 2010. For scholars interested in using these data as a single variable, we have also created a composite index called the “Competition Law Index” that draws on many of these variables to create a single picture of the regulatory risk posed by countries’ competition regimes in each year from 1890 to 2010 (see Bradford & Chilton ).…”
