Despite significant progress in business and human rights (BHR) discourse and the practices of multinational corporations (MNCs), persons with disabilities and disability rights are absent from both the key instruments and practice of BHR. This lacuna exists despite the near-universal ratification of the United Nations (UN) Convention on the Rights of Persons with Disabilities, as well as the fact that disabled persons constitute over 15 per cent of the global population and MNC operations impact them greatly and disproportionately. We argue that MNCs have a central role, responsibility and opportunity to foment change globally in fulfilling the human rights of persons with disabilities through their employment practices and by leveraging their economic power to fulfil other aspects of disability-based human rights. Doing so requires the development and self-enforcement of disability-specific human rights due diligence (HRDD) processes, and creating a general culture of diversity, equity and inclusion that encompasses disability.

Traditional frames for addressing disability—as a medical problem needing a “fix” or “cure,” or as a charity endeavor provoking paternalistic impulses—perpetuate stereotyping, undermine agency, and entrench exclusion. The historical invisibility of persons with disabilities compromises development in poor and fragile states. Adoption of the Convention on the Rights of Persons with Disabilities in 2006 is beginning to promote inclusion of people with disabilities. This chapter situates the global movement for inclusion in diplomacy, peacebuilding, and development, presenting its challenges, opportunities for advancement, and current examples of progress. It draws on the authors’ collective experience as legal advisors for the Convention on the Rights of Persons with Disabilities at the UN; working in more than forty countries implementing disability laws and policies; leading donor efforts to ensure disability inclusion in development and humanitarian action; and advancing scholarship at the Harvard Law School Project on Disability.

Part II identifies the substantial legal and social pressures motivating older persons not to identify as a person with a disability. Whether a person decides to identify as old or person with a disability is a personal preference.
