This paper explores the complex relationship between intellectual property (IP) and the transdisciplinary collaborative design (co-design) of new digital technologies for agriculture (AgTech). More specifically, it explores how prioritizing the capturing of IP as a central researcher responsibility can cause disruptions to research relationships and project outcomes. We argue that boundary-making processes associated with IP create a particular context through which responsibility can, and must, be located and cultivated by researchers working within transdisciplinary collaborations. We draw from interview data and situated IP practices from a transdisciplinary co-design project in Aotearoa New Zealand to illustrate how IP is a fluid boundary-requiring-and-producing object that impels researchers into its management, and produces tensions that need to be noticed and skillfully navigated within research relations. We propose located response-ability as a conceptual tool and practice to reposition IP within the relations that make up a transdisciplinary co-design project, as opposed to prioritizing IP by default without recognizing its possible impacts on collaborative relations and other project aims and accountabilities. This can support researchers practicing responsible innovation in making everyday decisions on how to protect potential IP without disrupting the collaborative relations that make the creation of potential IP possible, and the existence of protected IP relevant and beneficial to project collaborators and wider societal actors. This may help to ensure that societal benefits can be generated, and positive science–society relationships prioritized and preserved, in the design of new AgTech.

ZusammenfassungSocial Machines sind ein Paradigma für die Gestaltung soziotechnischer Systeme, die unter Verwendung von Web- und Plattformlösungen das Potenzial digitaler Technologien mit der Eigenlogik sozialer Interaktion, Organisation und Strukturbildung auf neue Weise zusammenführen. Im Folgenden diskutieren wir das Paradigma der Social Machine aus den Perspektiven der Informatik, der Wirtschaftsinformatik, der Soziologie und des Rechts, um Orientierungspunkte für seine Gestaltung zu identifizieren. Der Begriff ist in der Literatur jedoch bisher nicht abschließend definiert sondern nur durch Beispiele illustriert.In diesem Artikel stellen wir zunächst die folgende Definition zur Diskussion: Social Machines sind soziotechnische Systeme, in denen die Prozesse sozialer Interaktion hybrid zwischen menschlichen und maschinellen Akteuren ablaufen und teilweise algorithmisiert sind. Im Anschluss beleuchten wir drei aktuelle, sich gegenseitig bedingende Entwicklungen von Social Machines: die immer stärkere Verschmelzung von Sozialität und Maschine, die Vermessung von Nutzeraktivitäten als Grundstoff gesellschaftlichen Zusammenhalts und die zunehmende Algorithmisierung gesellschaftlicher Prozesse. Abschließend diskutieren wir, dass eine teilhabeorientierte, demokratischen Werten folgende Gestaltung von Social Machines die Perspektiven der Nutzungsakzeptanz, der gesellschaftlichen Akzeptabilität und der nachhaltigen Wirtschaftlichkeit adressieren und umsetzen muss.

This chapter interrogates “data justice” through the lenses of feminist and legal studies to reconfigure data justice as a multidimensional, interdisciplinary practice in IT-design. First, we look at how data justice is framed in feminist research and feminist-informed critical data and design perspectives, as well as how it is conceptualised in law, particularly in the context of the European General Data Protection Regulation (GDPR) and legal debates around privacy in Europe. Second, we recommend conceptual shifts, design approaches, and legal measures towards data justice. Our chapter contributes to new perspectives in critical data studies by showing that data justice can provide a conceptual ground that serves both the needs of legal formalisation as well as feminist imperatives of contextualisation and specificity.
