Abstract:Resumo Neste artigo, a partir do estudo de um caso concreto em que se declarou a possibilidade de ocorrência de “racismo reverso”, busca-se refletir - tendo como chave heurística central uma concepção materialista da colonialidade - sobre como o direito e o poder judiciário se inserem nos processos de construção de subalternização e como leis antidiscriminatórias atuam para relegitimar um sistema penal, historicamente racista, em sua totalidade.
