The Covid-19 pandemic that has hit the entire population of the world in recent times has had a significant impact on human life. People around the world have to start getting used to adapting to new habits due to the presence of the Covid-19 virus. This is also the case in Indonesia, one of the government's policies is to issue a policy to carry out all activities at home, starting from work, school, and the obligation to limit activities outside the home or even limit meeting people. This policy also has an impact on the performance of the Notary, where the Notary in making an authentic deed is obliged to deal with the parties. The solution related to this then emerged a policy regarding cyber notary, where in making an authentic deed the Notary does not have to deal with the client and the deed can be signed electronically. This policy raises pros and cons, including the authenticity of the GMS deed which is carried out using the cyber notary method. This study uses a normative juridical method with a qualitative approach. The purpose of this study is to find out about the authenticity of the deed of the GMS made with a cyber notary during the covid-19 pandemic. The result of this research is that the deed of the GMS made using the cyber notary method is an authentic deed if it is made on the basis of the lex specialist derogate legi generali principle. it is in Article 77 paragraph (1) in conjunction with Article 77 paragraph (4) of the Limited Liability Company Law. After the parties have signed the deed of the GMS, the Notary on the basis of Article 11 of the ITE Law and the fulfillment of the lex specialist principle, the deed can be used as perfect evidence in court.

The concept of Cyber Notary in Indonesia is influenced by the advance of technology, the need of the society, and the way people think. Cyber notary is mentioned in the amended Law on Notary (Amended UUJN) in the form of other authorities, which is to certify transaction made electronically (cyber notary). However, in the level of legal practice, cyber notary’s authority is not performed effectively by notaries in real practice. This study aimed to examine the aspect of legal certainty of cyber notary and how far the chance of UUJN’s Amendment is able to provide certainty for the implementation of cyber notary. This study was conducted using normative legal research method, a descriptive method, through statute approach and history approach. The result of this research shows that: first, notary’s authority in cyber notary is merely to legalize an electronic document and privately made deed. The second, the certification of a transaction which is done electronically (cyber notary) by Notary has validity or legally valid and is not against the principle of Tabellionis Officium Fidelliter Exercebo because during the process notaries is present directly. Based on the result of this study, the suggestion that can be given is that it is necessary to amend UUJN and to formulate implementing regulation of the mechanism of notary’s authority to certify electronic transaction.

Cyber notary implies notarial deed made through electronic device or notary, agreement that reads and knows deed isn’t carried out before notary. This writing aims to analyze validity of authentic deed transaction certification carried out with cyber notary and strength of notary deed proof in concept implementing cyber notary in Indonesia. Researchers use legal research methods using normative juridical approach, namely the concept of positivist legis. The certification transactions using cyber notary is legal, it has been regulated in Article 15 paragraph (3) of Law Number 2 of 2014 which authorizes notary to certify transactions in cyber notary manner while still taking into account the elements of an authentic document. Notary document that based on cyber notary in form of an electronic or electronic document, doesn’t or has not fulfilled the conditions as a valid document based on the Act on Changes Notary Position or Law on Information and Electronic Transactions. Thus, power of proof is the same as power of proof letter or document made under the hand. Therefore, preserve the authenticity of deed electronically made using draft of cyber notary that have perfection.Keywords: validity; evidence; cyber notaryAbstrakCyber notary memiliki definisi bahwasanya akta notaris yang diterbitkan menggunakan perangkat elektronik atau seorang Notaris cuma memvalidasi sebuah perjanjian dimana pembacaan serta penandatanganan aktanya tidaklah dikerjakan di depan Notaris. Artikel ini bertujuan untuk menganalisis keabsahan sertifikasi transaksi akta otentik yang dilakukan dengan “cyber notary” dan kekuatan pembuktian akta Notaris pada konsep implementasi “cyber notary” di Indonesia. Artikel ini menggunakan metode yuridis normatif. Pensertifikatan transaksi yang memakai cyber notary merupakan hal yang legal sebagaimana diatur di Pasal 15 ayat (3) Undang-undang Nomor 2 Tahun 2014 yang memberi wewenang pada notaris dalam menerapkan pensertifikasian transaksi dengan cara “cyber notary” tanpa mengabaikan unsur akta asli. Akta Notaris yang didasarkan pada konsep “cyber notary” berupa akta elektronik atau elektronik, tidak atau belum memenuhi persyaratan sebagai akta otentik menurut perundang-undangan Perubahan wewenang Notaris atau perundang-undangan Informasi dan Transaksi Elektronik. Kekuatan pembuktian sama kuatnya dengan suatu surat atau akta yang diteken di bawah tangan. Hal tersebut untuk menjaga keaslian akta yang dibuat secara elektronik melalui konsep cyber notary yang memiliki kesempurnaan.Kata kunci: keabsahan; pembuktian; cyber notary
