The paper discusses the role of police, public prosecutor and court in combating domestic violence and the effects achieved in the 2018-2021 period. The aim of the study was to establish whether the provisions of the law that empower the police and judicial bodies are adequately implemented in the entire territory of the Republic of Serbia and whether they offer sufficient mechanisms to efficiently and effectively prevent and suppress domestic violence and provide efficient protection of the victims. The study also aimed to establish what effects were achieved by proactive approach of the relevant authorities in the analysed four-year period, what the sentencing policy of the courts has been, and how efficient the public prosecution was in suppressing domestic violence. The research results have shown that the effects of the new concept applied in suppressing domestic violence are not uniform in all the regions of Serbia, that there has been a decrease in the number of criminal offences, but that the number of fatalities among family members has not declined.

The paper focuses on the analysis of the practical application of the Law on the Prevention of Domestic Violence which prescribes a proactive way of work of competent authorities. Research results have been presented, encompassing registered events with elements of domestic violence in the Republic of Serbia in the 2018 - 2023 period, as well as the measures taken by the competent authorities (police, public prosecutor's office, and court) in order to prevent domestic violence and protect victims. A comprehensive analysis of the practical implementation of the law was made, where the data related to statistical regions in the Republic of Serbia were compared in order to establish the effects of the law implementation in each part of the country. The research results showed that the work of competent authorities needs to be standardized in the future as there were significant differences in the manner of operation. The problems encountered in the practical implementation of certain legal provisions were considered and certain recommendations were given. The work of coordination and cooperation groups formed in 63 areas throughout Serbia, whose primary task is to take timely and effective measures aimed at protecting victims, defined by the individual victim protection plan, following a high-quality comprehensive risk assessment regarding the possibility of recurrence of violence and the occurrence of the gravest consequences for the victim. The author concludes that the implementation of the pre-crime concept in this area and targeting potential perpetrators prior to commission of the criminal offence, regardless of whether the offence would ever be committed, renders certain positive effects which are mostly reflected in the decrease in the number of the most serious forms of domestic violence which result in the loss of a family member's life, especially those affecting female victims of violence, who are the most threatened by this type of crime. Achieving this goal was one of the reasons for passing the law under review.

After the Law on Public Order and Peace in 2016 had been passed, a public space became a substance of the criminal offense referred to in this law. Given that violence in partner and family relationships most often occurs in a non-public area, misdemeanor courts have lost their previous role in protecting victims against certain forms of domestic violence that lack the characteristics of a criminal offense. However, misdemeanor courts have been assigned a new significant role through both the implementation of the Law on Prevention of Domestic Violence on 1 June 2017 and prescription of offenses set out in Article 36. They have become responsible for the prevention of domestic violence. In this paper, we will tackle certain segments of misdemeanor-legal protection of victims of domestic violence over the course of a five-year period with regards to the implementation of the aforementioned law. We believe that one of the goals of passing the law was to prevent all forms of domestic violence from the first moment of its occurrence, meaning that misdemeanor courts are an important entity in fulfilling this goal, primarily in the area of the implementation of urgent measures.
