In ihrer Arbeit untersucht Stine von Förster das Vorgehen von staatlichen Einsatzkräften bei der Migrationskontrolle in Spanien, Italien, Griechenland und Bulgarien. Dabei steht die völkerstrafrechtliche Relevanz des Umgangs mit Migranten im direkten Zusammenhang mit der irregulären Einreise in die Europäische Union im Fokus. Berücksichtigt werden bei der Betrachtung der Geschehnisse an den Grenzen der südlichen EU-Mitgliedstaaten auch Vorkommnisse auf dem Mittelmeer – also noch vor dem eigentlichen Grenzübertritt – sowie der Umgang mit irregulären Migranten im direkten Anschluss des Grenzübertritts. Hauptgegenstand der Arbeit ist die Frage, ob es bei dem Umgang mit irregulär Migrierenden an den südlichen EU-Außengrenzen zu Verbrechen gegen die Menschlichkeit gemäß Artikel 7 Römisches Statut des Internationalen Strafgerichtshofs durch staatliche Einsatzkräfte kommt.
