Acquisition of Agricultural Land by Foreigners and Family Agricultural Holdings in Croatia

Abstract: This paper presents two important aspects of the structural transformation of the agricultural sector of the Republic of Croatia. “…In their case, the precondition for the acquisition of real estate is that the reciprocity with their country is established by a decision of the competent authority, in accordance with the Reciprocity Act. 14 Citizens of other countries may not acquire real estate on the basis of inter vivos transactions at all, while on the basis of inheritance only if reciprocity exists. The Croatian Constitution [Ustav Republike Hrvatske] expressly states that arable land is of fundamental importance and therefore enjoys special protection of the Republic of Croatia.…”
