A Glimpse of Forensic Medicine Practices in Ottoman Court Records: Review

Abstract

Ö ÖZ ZE ET T Adli tıp, hukukun tıpla kesiştiği alanlarda bilirkişilik sunan bir bilim dalıdır. Türkiye'de ilk otopsi Dr. Charles Ambroise Bernard'ın gelmesiyle yapılmış olup daha önceki dönemlere ait adli tıbbi uygulamaların nasıl yapıldığı ile ilgili bilgiler ise kadılık müessesi tarafından oluşturulan hukuki metinlerde izlenmektedir. Osmanlı Devleti'nin 15. yüzyıl ile 20. yüzyıl arasındaki toplumun etnik yapısı, iktisadi, siyasi, sosyal, hukuki hayatı ve tıp tarihi ile ilgili bilgileri içeren bu metinlere şer'iyye sicilleri denmektedir. Bu sicillerde bazı hastalıklar, tedavi yöntemleri, ilaç uygulamaları, hekim hasta ilişkileri, sağlıkla ilgili fermanlar, bilirkişilik, aydınlatılmış onam gibi tıp tarihi, deontoloji ve adli tıbbi uygulamaları ilgilendiren metinler bulunmaktadır. Bu çalışmada çevirisi yapıl-mış şer'iyye sicillerinden yararlanılarak Osmanlı dönemindeki adli tıbbi uygulamalar değerlen-dirilmiştir. Osmanlı döneminde günümüzde olduğu gibi ölümlü olaylarda keşif yapıldığı ve bu keşiflerde hekimlere danışılabildiği görülmüştür. Mahkeme sürecinde kişiler arasında çıkan anlaş-mazlıklarda hekimlerden bilirkişi raporu istendiği ve rapor sonucuna göre mahkemenin şekillendiği izlenmiştir. Ayrıca, mahkeme huzurunda tıbbi girişimlerden önce hastalardan aydınlatılmış onama benzer rıza senedi örnekleri alınmıştır. Aynı zamanda şer'iyye sicillerinde günümüzde olduğu gibi tıbbi girişim veya tedavilerden sonra zaman zaman hekimlerden şikâyetçi olunduğu görülmüştür. Şer'iyye sicilleri bulunduğu dönemle ilgili önemli bilgiler vermesinden dolayı bu metinler üzerinde yeni araştırmalar yapılmasıyla, adli tıp tarihi ve uygulamalarını ilgilendiren yeni belgelerin ortaya çıkması sağlanacaktır.A An na ah ht ta ar r K Ke el li im me el le er r: : Adli tıp; bilgilendirilmiş onam; tıp tarihi A AB BS ST TR RA AC CT T Forensic medicine is a branch of science that offers expertise in areas where law and medicine are intersected. In Turkey, the first autopsy performed with the arrival of Dr. Charles Ambroise Bernard and the information on the way in which forensic procedures were performed in previous eras can be traced in legal texts created by the institution of the 'kadı' (Muslim judge). These texts that include information on the ethnic composition, economic, political, social and legal life of the society as well as history of medicine in the period between the 15 th and 20 th century are called "şer'iyye sicilleri" (court records). These records include texts related to history of medicine, deontology and forensic science procedures on topics such as certain diseases, treatment methods, drug administrations, patient-physician relations, health-related firmans, expertness and informed consent forms. In this article, the forensic medicine procedures in the Ottoman era were evaluated in the light of translated court records.
