La era Vargas y la trayectoria del Supremo Tribunal Federal de Brasil: un análisis histórico institucional 1930-1945Andrés del Río 1 ResumenEn el presente trabajo analizamos el proceso de desarrollo institucional del Supremo Tribunal Federal de Brasil durante el periodo varguista (1930)(1931)(1932)(1933)(1934)(1935)(1936)(1937)(1938)(1939)(1940)(1941)(1942)(1943)(1944)(1945) [1930][1931][1932][1933][1934][1935][1936][1937][1938][1939][1940][1941][1942][1943][1944][1945], by studying the institutional shifts to have taken place during the period. To do so, the work focuses on the significant legislative modifications, the trend toward jurisprudence and the fluctuations in the composition of the Supreme Court. RESUMO.Compreender a dinâmica de circulação de representações sociais da criança e do adolescente, entre os atores sociais que participaram da Assembléia Constituinte 1987-88 (ANC 87-88), na qual se deu o reconhecimento legal dos seus direitos e proteção, eis o objetivo do estudo. O trato público dispensado à criança e ao adolescente, na tessitura da história social brasileira, foi abordado, como lócus de representações, espaços e práticas sociais. A investigação adentra seu universo empírico, a ANC, que elaborou a Constituição Federal, com inovações legais sobre a criança e o adolescente. A investigação fez constatações numa dupla direção: distanciamento entre produção constituinte e Constituição; entre produção constituinte e pensamento social. O Brasil pós-constituinte é contextualizado tendo-se como referência analítica representações da criança e do adolescente.Palavras-chave: criança e adolescente, representações sociais, constituinte. CHILD AND ADOLESCENT, SOCIAL REPRESENTATIONS AND CONSTITUTION PROCESSABSTRACT. The purpose of this study was too understand the dynamic of the social representations concerning children and adolescents, among the social representatives who participated in the 1987-88 National Constitution Assembly, in which children and adolescents were given their legal protection rights. The public dealings granted to the child and the adolescent, in the social Brazilian history were approached as a locus of representations, spaces and social practices. The investigation advanced into its empirical universe, the National Constitution Assembly, which elaborated the Federal Constitution, with legal innovations for the child and the adolescent. The analysis lead to discoveries in a two-way direction: the distancing between the Constitution Process and the constitution text; the distancing of the constitution outcome and the Brazilian social thoughts. Brazil after the Constituent Assembly is updated, having as analytical reference the social representations of children and adolescents.Key words: child and adolescent, social representations, constitution process. 12* Professora da UFC, Doutora em Sociologia. 1Compusemos um grupo que, nos recantos mais diversos do Brasil, desenvolveu um trabalho social que transformou o problema do "menor" em um problema social, de forma que a sociedade dele tomasse conhecimento e o colocasse em suas pautas de preocupação, bem como que a questão da criança e do adolescente passasse também a ser objeto de lei, de políticas públicas. 2Com o mesmo mote, pesquisadores, entre os quais destaco Vasconcelos (1996) e Carvalho (1995, vêm se debruçando sobre a diferença entre o teor da lei e a realidade, abordando o distanciamento entre os mesmos e interpretações várias formuladas sobre o Estatuto da Criança e do Adolescente (ECA).
