Landless farmworkers in Brazil typically occupy land that is legally eligible for expropriation, but the state normally does not expropriate until a land occupation forces the hand of authorities. Landowners and local authorities in the Brazilian countryside frequently respond to occupations with violent repression. Their action reflects the hybrid character of the Brazilian state, modern and rational in cities and at the federal level but, in many rural areas, still clientelistic and marked by nonlegitimate violence. Land occupiers, landowners, and authorities jointly enact a repertoire of collective action that corresponds to the backward character of the state in those areas. The action of the land occupiers, however, is legitimated by the claim of civil disobedience while the efforts to repress them cannot lay claim to legitimacy on that basis.

O presente artigo trata de um Assentamento Rural na cidade de Promissão em São Paulo, constituído em 1986. A pesquisa procurou abordar os modos de apropriação das terras no assentamento como terra camponesa em suas múltiplas formas, as quais chamei de pluriapropriação. As condições de apropriação e transmissão da terra no assentamento se davam em desacordo com a normatização que rege os programas de assentamentos rurais no país, tornando os assentados “fora da lei”. São considerados ilegais o arrendamento de terra, o fracionamento do lote, o exercício de atividades assalariadas pelos titulares e a comercialização dos direitos de posse. O inquérito instaurado pelo Incra, transformado em processo administrativo, constatou que as transações de venda e transmissão de direitos no assentamento de Promissão, realizadas até 1998, eram irregulares. Algumas delas foram regularizadas, considerando que o perfil dos compradores atendia às exigências legais, mesmo que as transações não as tivessem atendidas. No entanto, a pesquisa demonstrou que as “vendas irregulares”, muitas vezes, atendiam as necessidades de reprodução social dos assentados, uma vez que os lotes comprados eram destinados aos filhos dos assentados que lá permaneciam.
