Zusammenfassung
Massenproteste gegen Austerität haben viele europäische Länder in den Jahren nach der Finanzkrise gekennzeichnet. Diese Auseinandersetzungen haben ebenfalls Interaktionen zwischen sozialen Bewegungen und rechtlichen Institutionen geprägt. Basierend auf dem Beispiel der „Rechtsprechung der Krise“ in Portugal wird in diesem Artikel eine theoretische Reflexion entwickelt, die sowohl die Grenzen des Rechtsmobilisierungsansatzes aufzeigt, als auch Forschungsansätze für eine materialistische Interpretation der Rechtsform anbietet. Dieser Ansatz verdeutlicht den widersprüchlichen Charakter der Anwendung von rechtlichen Strategien durch soziale Bewegungen.
