Background. Medical practice requires decisions that are risky in nature and their positive outcome cannot be guaranteed. The reasons for this can be varied, but also with a proper and professional approach by the treating attending physician and other medical personnel adverse effects of the treatment or research carried out should not also be interpreted as criminal acts, which justifies a thorough examination of the attributes and types of reasonably medical risks and the conditions for their legitimacy. Materials and methods. An analysis of the sources of legal regulation of medical activity, including criminal legislation, was carried out and law enforcement practice was studied. The paper used the formal-legal method to identify and specify the conditions for the legitimacy of medical occupational risks. Results. Occupational medical risk is a type of reasonable risk, that is a circumstance precluding criminality of an act, and depending on the socially useful purpose of the intervention in the functioning of the human body, it can be innovative and treatment. Conclusion. Qualification of occupational medical risk as a reasonable risk requires taking into account consideration of the full content of the situation of its application in each case. In doing so, there is no need for a separate regulation on the legitimacy of medical risk, but Article 41 of the Criminal Code may be supplemented by a condition to exclude informed consent of the patient or his statutory representative, when it is carried out on emergency evidence to eliminate the threat to a person’s life.
The article considers and reviews the three-volume monograph «Military Law» under the general editorship of A. N. Savenkov and V. Kudashkin from the point of view of using its results in the process of training and professional activity of future employees in the transport sector. Positively evaluating the structure and content of the monograph, special attention is paid to the fact that it contains valuable information for the transport sector of the country. The authors of the review note that the monograph is able to meet the needs of modern transport education, taking into account the need for future specialists to develop legal knowledge about military transport duties and the military segment of transport relations. The review accentuate the achievements in this area and substantiate the prospects for further research.The authors of the review also believe that it would be possible to dwell in more detail on the issues of military transport duty, which could be an excellent addition to the reviewed three-volume monograph.
We raise the topic of the social services current system, the place and importance of nonprofit organizations in it. It is noted that the tendency of social services nonprofit sector transfer to the population with the subsequent reimbursement of expenses from the budget. We analyze various barriers of nonprofit organizations participation in the social services provision in the context of which it is proposed to provide an advance mechanism for reimbursement of nonprofit organizations for the social services provision. The importance of the social services standard is emphasized, its content is revealed and an attempt is made to reveal the legal nature of the standard of social services. We note the content of the standard established by the federal legislation; also we draw attention to the fact that the procedure approval for the social services provision by social service providers is attributed to the powers of public authorities of the subjects of the Russian Federation. We present the analysis of the social services provision standard in the Tambov Region by forms of social services approved by the order of Social Protection and Family Policy Department of the Tambov Region dated April 1, 2016 no. 463-ф. The points requiring adjustment from the point of view of legal technique are revealed, and also other offers on modification of the specified regulatory legal act are specified. As a result, we conclude that the social services standard, firstly, expresses the amount of social assistance guaranteed by the state, secondly, it is an exhaustive set of requirements for the service itself, allowing to plan activities and resources, and, thirdly, it is a set of requirements for quality control of social services and protection of the rights and legitimate interests of their recipients.
We present the review of the All-Russian scientific and practical conference with international participation “Current problems of agricultural law” held on October 16–19, 2019 with the support of the Russian Foundation for Basic Research (Project no. 19-01-20101). The conference program included the work of the plenary session, seven sections: “General issues of agricultural law”, “State regulation of the agricultural sector”, “Problems of legal support of organic production, selection and seed production, nursery farming”, “Problems of legal support of crop production and animal breed-ing”, “Relationship of agricultural and land law”, “Relationship of agricul-tural and environmental law”, “School of young scientists”. At the same time with the conference, refresher courses “Agricultural, land and environmental law” were organized. The conference was attended by researchers, research workers, lecturers of educational institutions, specialists in the field of agri-cultural and other branches of law, representatives of state authorities, experts in the field of agriculture. Participants of the conference during numerous debates discussed the situation in the regulatory legal framework for the activities of the agroindustrial complex of the Russian Federation and recognized the need to strengthen coordination of work in this area, the starting point of which was the past conference, and also came to the conclusions set forth in the Decision.
