O tema central deste artigo é o Programa Universidade para Todos (PROUNI), criado pelo governo federal em 2004 visando à expansão do acesso à educação superior no país. Analisamos a política, tomando como referência a proposta de definição criada por Lasswell (1936). Buscamos identificar quais atores ganharam o quê, quando e como, a partir do processo político desenvolvido durante a formulação do programa. A hipótese de trabalho foi construída a partir de Pinto (2004), o qual sugeriu que as instituições privadas de educação superior passariam a pressionar o governo em busca de recursos para superar a situação diagnosticada no início da última década, quando as taxas de ociosidade de vagas andavam acima de 740 mil. Analisamos os principais mecanismos do PROUNI: os critérios de acesso, os tipos de bolsas, as exigências qualitativas do ensino e os mecanismos de controle institucionais criados para acompanhar a implementação da política. Em razão disso, concluímos que os atores sociais privatistas tiveram êxito em influenciar as decisões governamentais em prol das expectativas do mercado, o que acarreta na ratificação da tese de Downs (1999), para o qual os atores que têm sua renda afetada por uma política pública estarão sempre mais bem informados e dispostos a participar das discussões que envolvem sua definição.
A reforma regulatória da década de 1990 apresentou profundas transformações nas relações entre as instituições brasileiras. Com a criação das agências reguladoras, uma nova governança regulatória foi estabelecida no país, com a delegação de poderes a entes autônomos para a regulação de setores fundamentais para os cidadãos. Com a inclusão de novos atores no ambiente regulatório - empresas nacionais e internacionais, novos usuários, investidores etc. -, fazem-se necessários mecanismos de transparência e prestação de contas. Com base nessas transformações, examino o papel do Tribunal de Contas da União (TCU) como instituição de accountability horizontal no controle das agências reguladoras. A análise é realizada a partir da coleta dos acórdãos da Corte de Contas, utilizando tanto pesquisa documental quanto entrevistas qualitativas com atores institucionais envolvidos nesse campo de estudo. Argumento que a atuação do TCU aumenta a legitimidade de ação das agências autônomas, na medida em que torna o processo de tomada de decisão mais transparente e democrático. Do ponto de vista do usuário, concluo que o poder de sanção do TCU tem contribuído para equilibrar a relação entre usuários e concessionárias, tendo em vista o aumento da representação das reivindicações dos cidadãos na arena regulatória. O artigo está dividido em quatro seções. Na primeira seção, a seguir, apresento a inserção do Tribunal de Contas da União no atual arranjo regulatório brasileiro e as hipóteses do artigo. Em seguida, na segunda seção, realizo uma discussão sobre os principais argumentos da literatura de delegação de poderes e accountability horizontal. Na terceira seção, há uma apresentação do desenho de pesquisa e do método utilizado neste estudo. Por fim, na quarta seção, faço uma análise de discurso de três acórdãos selecionados para este artigo com o objetivo de testar as hipóteses apresentadas na primeira seção.
O objetivo deste artigo é analisar o controle externo exercido pelas instituições do Poder Legislativo na Argentina, Brasil e Chile. As questões de fundo deste estudo são: em que medida as instituições de fiscalização podem contribuir para a qualidade da democracia? Em outras palavras, essas instituições contribuem para aumentar a accountability da burocracia do Executivo? O estudo discute o desenho institucional dos três países, apontando suas virtudes e problemas. A metodologia de pesquisa é do tipo qualitativa, com o uso das técnicas de análise comparada e documental. O presente artigo realiza uma análise institucional comparada entre os países da América Latina, no que se refere ao desenho institucional dos órgãos de controle externo à luz dos conceitos de accountability horizontal e da qualidade da democracia. Foram selecionados os países que compõem a Organização Latino Americana e do Caribe de Entidades Fiscalizadoras Superiores (OLACEFS), uma entidade cujo objetivo é o intercâmbio de boas práticas de controle externo entre os seus países membros. O argumento central é o de que essas instituições contribuem para a qualidade da democracia, uma vez que apresentam como principal missão inibir possíveis ações ilegais da burocracia e dos políticos eleitos, possibilitando o amadurecimento das instituições republicanas. Este é um estudo exploratório, no qual o principal objetivo é entender o contexto institucional aos quais os órgãos de controle externo estão inseridos.
The challenges to public policy brought by climate change are some of the biggest challenges for cities around the world. These challenges are costlier and more substantial for low-income communities given the existence of their greater social and economic vulnerability. Among the existing tools, this paper highlights the role played by urban living labs (ULLs), which have been discussed in the literature as a booster of urban resilience in a more sustainable direction. By considering ULLs as strategic institutional arrangements that seek resilience for the critical urban infrastructure challenges of climate change, the main target of this paper is to analyze ULLs as a strategy for increasing critical infrastructure resilience in the region of the Global South. These labs were initiated in developed countries, so we can ask: How are developing countries adapting this strategy in order to mitigate the problems of climate change? To achieve this goal, we reviewed previous literature on ULLs, specifically looking for case studies with ULL projects and highlighting the processes of public innovation policies and transfers of knowledge between countries; in order to complement our empirical analysis, we carried out a case study on Brazil. Despite the limitations of the sample, the data suggest the existence of different barriers to the implementation of ULL projects in Brazil compared to those in European cities.
