The vast and multidimensional impact of the Covid-19 pandemic has forced all countries to establish policies to prevent the transmission of Covid-19, including Indonesia. Not a few countries are not ready to make decisions to find new, more effective ways to prevent Covid-19. In Islamic law, ijtihad is part of lawmaking in the implementation of worship and muamalah, which solves problems that arise and mitigates policy implementation. This article uses a normative juridical approach to the issue because it can showcase the benefit of Islamic law for humans. Moreover, it aims to generate ideas in the renewal of Islamic law, especially in the implementation of worship and muamalah (social transaction/relation), and inform the government to make decisions that intersect with Islamic law during the Covid-19 pandemic. The focus of this research is how does covid-19 affect the practice of Islamic law in worship and mu`amalah? This study finds that government policies and regulations are currently in line with Islamic law. The most critical considerations in determining the compatibility of government policies and rules with shari’a are maintaining the soul’s safety, maintaining the continuity of religion through rukhshah, and maintaining the economy. Also, the Islamic rulings (fatwa) issued by ulama in response to government policies and rules are expected to guide worship and mu`amalah, build awareness and solidarity of Muslims, and relate to the people’s economy today.Keywords: Maqashid al-Shariah, Islamic law renewal, new normal rules, covid-19

Subsequently, it developed in the hands of Imam Haramain Al-Juwayni, who categorized it into three main topics: al-ḍarūrīyāt (necessities), al-ḥājjiyāt (needs), and al-taḥsīnīyāt (improvements) (Anshor & Muttaqin, 2020). The application of sharia in Islam is a matter that must be done, in the form of worship, mua'amalah and law. However, in legal practice, often the application of the Shari'ah encounters many obstacles in the form of protests or rejections from many parties. This is triggered by the conception of Human Rights (HAM) which has been raised by the West in the 19th century. Thus, it is widely stated that shari'ah in Islam, especially in the application of law (hudūd) is widely seen as treatment that is not in accordance with human rights. However, it turns out that the conception of human rights and humanity implied in it still has various epistemological and theological problems. Human rights that have been discoursed by the West are completely loaded with the paradigm of Humanism-Secular which is very contradictory in Islam. For this reason, Muslims design a separate conception of human rights that is in accordance with the Islamic worldview. So, in this article, the author will discuss the suitability of the purpose of implementing sharia or maqāṣid al-sharī'ah with humanity based on an Islamic view. This study aimed to shed light on the urgency of nurturing business resilience and creative economy in developing the micro, small, and medium enterprises (MSMEs) through an Islamic economics approach post the Corona Virus Disease 2019 (commonly known as COVID-19) pandemic. It is driven by the downturn of MSMEs during the COVID-19 pandemic. MSMEs themselves are the foundation of community’s economic stability. Thus, the effect of MSMEs’ downturn is heartily felt by the community. In the study of Islamic economics itself, a system of alleviating economic downturn is a necessity along with the system of justice and equity. Based on this problem, this literature-based study critically examines the position of Islamic economy in the implementation of business resilience and creative economy in restoring the dignity of MSMEs post COVID-19 pandemic viewed from maqāṣid sharī’ah (purposes of Islamic law) perspective. The findings show that strengthening MSMEs post COVID-19 pandemic fits both the creative economy and Islamic economic models and is in line with maqāṣid sharī’ah, especially with ḥifẓ al-nafs (preserving one’s soul) and ḥifẓ al-māl (preserving one’s wealth).
