Nigeria has recently renewed efforts towards stamping out corruption in every area of its national life. Given that construction procurement is particularly prone to corrupt practices, this study investigated the prevalence of unethical tendering practices in the Nigerian public sector. In particular, a comparison to bare the similarities or differences in the prevalence of unethical tendering practices at national and subnational levels is scarcely available in literature. This study’s objective was to determine and compare the prevalence of unethical tendering practices at the national and subnational levels in Nigeria. The data analysis was based on 120 acceptably filled questionnaires obtained from contractor, client and consultant organisations previously involved in public sector projects. The unethical tendering practices were analysed using prevalence indices and Mann–Whitney U tests. Findings include that the three most prevalent unethical tendering practices are contractor-based, namely: (1) competitors offer bribes to gain access to confidential tendering information (C1); (2) competitors overstate their capacity, experience and qualifications to secure construction contracts (C2); (3) the same owner(s) use different firms to tender for the same project (C3), in descending order of prevalence. No significant difference exists between unethical tendering practices in federal and state government projects. The findings of the study will help the Nigerian government and other stakeholders to better understand unethical practices at the tender stage of construction procurement in the public sector and to evolve better strategies for dealing with them. The study contributes to existing knowledge by separately identifying the prevalent unethical tendering practices in the Nigerian context and comparing unethical tendering practices at national and subnational levels within a country

Unethical performance is an impediment for economic development and good governance. It is more than true to say it is the bane of development in developing nations of the world under which Nigeria is categorized. The construction sector was highlighted for its practices in areas such as bribery, environmental destruction, capital flight, dangerous practices, poor quality, whistle blowing, etc. and it is also associated with unethical behaviour through the entire construction life cycle. This paper therefore, x-rayed the determinants of unethical performance in Nigerian construction industry with a view to identifying the causes in all the stages of building project. Well structured questionnaires were self administered to direct stakeholder involved in the execution of building projects considered for this research work. Literature review revealed that corruption is evident in the construction industry which causes a lot of setback to project such as abandonment of such project and if complete may be completed below standard. Data were presented and analyzed using non parametric statistic; tools used were Severity indices and Relative importance index rather than mean scores since the data were ordinal in nature. It was observed that the building construction industry is perceived to be more susceptible to ethical problems because of several features and that corruption has effect on all stages of construction right from Planning, Tender stage to Completion stage. It was recommended that viable legislation as a mechanism to deal with small levels of corruption by strengthening professional institutions that will punish erring members will prevent corruption to a certain degree; and enforcement and monitoring measures of anti corruption agencies is believed can enhance transparency, accountability and reduced unethical behavior, and this will create an enabling environment possible for the industry to thrive, operate, and improve on quality and quantity of infrastructure on a more sustainable basis and thereby foster good construction practice ethics.

Analysis of international construction companies in the context of corporate codes of ethics: Example of Turkey

Determination of corporate codes of ethics is crucial for construction companies, but they usually fail to define their codes. This study aims to evaluate the relationship between the guidance degree of ethical codes and being an international construction company in Turkey as a developing country. For this purpose in the scope of the study Turkish construction companies in "the Top 250 International Contractors in 2016" list of ENR (Engineering News Record) were analyzed in terms of guidance degree of corporate codes of ethics. The existence of the companies` ethical codes has been explored and the codes were evaluated in terms of their guidance degree. The study showed that there was not a relationship between the guidance degree of codes of ethics and being an international construction company. It is also found out that ethical codes were prepared to protect the interests of the company rather than to direct the employees to ethical behavior. Results of this study are expected to constitute a basis for the development of new ethical codes and to help the improvement of the existing codes. In order to be successful in ethical practices, ethical statements should be defined clearly and the ethical codes should be developed to direct employees to ethical behavior.
