El presente artículo tiene como objetivo analizar el desarrollo de la interpretación judicial del Tribunal Electoral del Poder Judicial de la Federación respecto al derecho de “autonomía política de los pueblos y comunidades indígenas” por lo que hace al procedimiento de consulta indígena para el cambio de régimen en la elección de sus autoridades municipales. Se realiza una semblanza del reconocimiento constitucional y legal del derecho de autonomía política indígena en México. Asimismo, se expone el avance jurisprudencial en materia electoral sobre el derecho indígena y se revisan las resoluciones emitidas por este tribunal vinculadas con la procedencia o improcedencia de tal procedimiento. The aim of this article is to analyze the development of the judicial interpretation of the Electoral Tribunal of the Federal Judicial Branch of Mexico with respect to the right of «political autonomy of the indigenous communities and native peoples» concerning the indigenous consultation procedure for the regime change of the municipal authorities’ election. The author describes the constitutional and legal recognition of the indigenous right to political autonomy in Mexico. Likewise, she exposes the jurisprudential advance on the electoral issues surrounding Indigenous Law and examines the judgments of this tribunal related to the admissibility or inadmissibility of such a procedure.
