Crianças E Adolescentes Em Situação De Rua: Sujeitos De Direitos?

Abstract

Neste artigo, discuto a “questão da rua” focalizando a população infantil e adolescente, a partir de uma breve retrospectiva de como o fenômeno se tornou visível e perturbador no Brasil nas décadas de 1980 e 1990. Este foi o período no qual a presença de crianças e adolescentes nas ruas teve grande repercussão e provocou uma série de acontecimentos, que trarei para a presente reflexão. Considerando o momento político que se vivia no país, de transição da ditadura ao processo de democratização, bem como a ratificação à Convenção dos Direitos da Criança (ONU, 1989) e a aprovação do Estatuto da Criança e do Adolescente (1990), analiso a pergunta sobre se seriam estes meninos e meninas reconhecidos como sujeitos de direitos ou mesmo humanos. Sendo em sua maioria pertencentes a segmentos de menor valimento social e humano (pobres, negros, favelados, e assim por diante), a eles foram atribuídas representações de criminalidade e periculosidade, negando-lhes o princípio de igualdade. Portanto, em franca oposição aos princípios universais de direitos humanos, até mesmo sua humanidade acaba sendo colocada em questão, por vezes por eles próprios.
