“…As justificativas expostas na pesquisa de Jason et al (2001) foram: 1) há benefícios para a comunidade quando se utilizam de pesquisas com uma amostra maior e mais aleatória, possibilitando a criação de programa preventivos de mais qualidade, 2) os pesquisadores podem ficar desmotivados em pesquisar assuntos que requerem o uso de consentimento ativo, optando por não realizar pesquisas com grupos vulneráveis e em maior risco, os quais seriam os mais favorecidos com a criação de intervenções e 3)estudantes maiores de 12 anos são capazes de entender os propósitos das pesquisas e os riscos e benefícios envolvidos, assim apenas a aceitação por escrito do estudante seria necessária. Quanto a essa terceira justificativa exposta por Jason et al (2001), seria importante em estudos futuros argumentá-la a partir de outros referenciais como o da bioética, no qual há discussões de quando indivíduos mais novos de 18 anos seriam capazes de tomar decisões sobre sua saúde (por exemplo, Udelsmann, 2006), o da justiça quando se propõe a idade para a maioridade penal, a do campo eleitoral, a qual estabelece a idade mínima para votar. Ainda, com relação a essa terceira justificativa, cabe lembrar que mesmo com o consentimento dos pais, no Brasil, as crianças e adolescentes também devem ser consultados e respeitados na sua decisão de participar ou não de uma pesquisa (Conselho Nacional de Saúde, 1996).…”
