Abstract

The importance of this theme is provided by the imperfection of the legislation regulating of these issues, and also set of disputes on this problem. The content of the right of ownership of the historical-cultural land (proprietary rights and existing restrictions), features of circulation of land plots is considered in this article. The characteristic of features of origin and the termination of the right of ownership to cultural heritage site is given in this article. The special attention in the article is given to the analysis of a legal regime of the land plot and the cultural heritage site located on it, and also the process privatization of monuments of history and culture is considered. Besides, in article the along with the consideration of the history of formation institute of a private ownership on the land plots carried to the historical-cultural land in Moscow and St.-Petersburg is also resulted world experience of the development of this institute.
