Pendahuluan: Kejahatan seksual banyak terjadi di Indonesia. Pada tahun 2010-2014, data dari Komisi Nasional Perlindungan Anak menunjukkan 42-62% dari seluruh kekerasan yang terjadi pada anak merupakan kejahatan seksual. Pelecehan seksual pada anak sering terjadi di tempat-tempat yang seharusnya menjadi tempat teraman bagi anak seperti di rumah atau di sekolah. Pelecehan seksual yang terjadi pada seorang anak dapat berupa verbal, non-verbal, maupun fisik, dan dapat berdampak pada anak secara fisik dan psikis. Peran dokter dalam kasus pelecehan seksual pada anak antara lain untuk pemeriksaan demi kepentingan peradilan serta tata laksana secara medis untuk mencegah dampak buruk jangka panjang yang dapat ditimbulkan dari korban pelecehan seksual.
Telah dilakukan pemeriksaan mikroskopik cairan irisan poru, yang dinamakan petneriksaan getah paru (Iung swap method), terhadap 49 korban yang meninggal akibat tenggelan dan 25 korban yang meninggal bukan akibat tenggelarn. Pada korban tenggelan didapatkan 91,8 % (45 dari 49 kasus) kasus menunjukkan adanya plankton dalatn cairan parunya, terdiri atas alga diatom dan alga non-diatom serta plankton non-alga. Pada 4 orang korban tenggelatn tidak dijwnpai adanya plankton sa,na sekali, dengan perincian 3 korban tenggelam dalam kolam dan I korban dalatn bak mandi, yang diduga terjadi akibat airnya bersih dan bebas plankton. Pada kelotnpok korban bukan tenggelatn, ditetnukan 4 % kasus (satu dari 25 k"ttsus) dengan 3 jenis alga yang berbeda dalatn cairan parunya, sedangkan 24 kasus lainnya tidak menunjukkan adanya plankton apopun. Pengujian ketnaknaan dengan uii Fischer pada kedua kelornpok menunjukkan adanya perbedaan yang bennakna (p < O,0OI) dengan risk ratio 22,96 dan odd ratio 270,00. Kotnposlsi plankton urnwnnya adalah campuran dengan do,ninasi diato,t, atau alga non-diatorn dan hanya sedikit saja yang menuniukkan adanya pl,ankton non-alga. Selain itu didapatkan bahwa pada kelonpok tenggela,n terdapat 14,4 % (7 dari 49 kasm) kasrs dengan plankton non-diatom saja. Pada kasus ini petneriksaan dengan netode destruksi asou, yang wtun dikerjakan, akan netnberikan hasil negatif palsu, karena plankton akan dihancurkan oleh asan. Pada kasus semacan ini peneriksaan getah paru lebih unggul daripada pe mer iksaan de struksi asam.
BACKGROUND The COVID-19 pandemic has caused many medical, ethical, and medicolegal changes, including constant adjustments in service guidelines. Continuing to revise healthcare regulations and guidelines can potentially cause clinical disputes or medical negligence that require ethical and legal solutions. This study aimed to determine the ethical and medicolegal aspects of the potential factors that cause clinical disputes during the pandemic and provide anticipative solutions to national ethicomedicolegal policies. METHODS A systematic literature search in PubMed, ScienceDirect, ClinicalKey, and Google Scholar was performed using keywords “clinical dispute,” “ethics,” “medicolegal,” “ethicolegal,” and “COVID-19”. The inclusion criteria were articles that contained information on shortage, justice, ethical distribution in intensive care, the possibility of lawsuits and disputes among stakeholders during the pandemic, and stakeholders’ roles in managing the pandemic. Key evidence was analyzed and synthesized following national ethicomedicolegal policies. RESULTS We identified 19 articles from the 4 databases. Based on the literature, the main ethicomedicolegal impact of the COVID-19 pandemic appears in 3 aspects: (1) a shortage of fair and ethical intensive care services with fair and ethical distribution efforts, (2) legal protection for medical personnel from legal charges while providing health services during the pandemic, and (3) the government’s role in managing the pandemic together with the stakeholders involved. CONCLUSIONS Ethicomedicolegal clinical dispute management and its norms require an update, especially when deciding the complexity of COVID-19 service standards. Ethicomedicolegal professionals are needed as intermediaries to manage cases of clinical disputes and to implement fair malpractice criteria in Indonesia.
