A solicitação de complementações pelos órgãos ambientais é apontada como causa na demora da emissão de licenças. Este trabalho investigou as complementações requisitadas pelo Instituto do Meio Ambiente de Santa Catarina (IMA), verificando se são oriundas de embasamento legal ou discricionariedade dos revisores. Foram analisados 19 processos de licenciamento ambiental com Avaliação de Impacto Ambiental (AIA) realizada por estudos simplificados. A ausência de documentos claramente descritos nas Instruções Normativas perfez 66% dos pedidos complementares, sendo causados pela desatenção dos consultores. Nos estudos ambientais, a descrição do empreendimento e os impactos ambientais/medidas mitigadoras foram os itens mais questionados pelos revisores. Os termos de referência genéricos das Resoluções do CONSEMA e/ou das Instruções Normativas, que não exigem sequer a eficiência dos controles ambientais, foram apontados como causa das exigências complementares. A discricionaridade incidiu em apenas 34% dos pedidos de complementação, sugerindo que os questionamentos dos revisores estão predominantemente previstos na legislação. O predomínio de complementações claramente descritas na legislação/atos normativos indica que a morosidade em processos de AIA com estudos simplificados tem grande contribuição dos consultores, não sendo causada exclusivamente pelo órgão ambiental. O diálogo entre consultores e revisores pode ser promissor para tornar o licenciamento menos subjetivo e imprevisível.
