Locomotion involves complex neural networks responsible for automatic and volitional actions. During locomotion, motor strategies can rapidly compensate for any obstruction or perturbation that could interfere with forward progression. In this pilot study, we examined the contribution of interlimb pathways for evoking muscle activation patterns in the contralateral limb when a unilateral perturbation was applied and in the case where body weight was externally supported. In particular, the latency of neuromuscular responses was measured, while the stimulus to afferent feedback was limited. The pilot experiment was conducted with six healthy young subjects. It employed the MIT-Skywalker (beta-prototype), a novel device intended for gait therapy. Subjects were asked to walk on the split-belt treadmill, while a fast unilateral perturbation was applied mid-stance by unexpectedly lowering one side of the split-treadmill walking surfaces. Subject's weight was externally supported via the body-weight support system consisting of an underneath bicycle seat and the torso was stabilized via a loosely fitted chest harness. Both the weight support and the chest harness limited the afferent feedback. The unilateral perturbations evoked changes in the electromyographic activity of the non-perturbed contralateral leg. The latency of all muscle responses exceeded 100 ms, which precludes the conjecture that spinal cord alone is responsible for the perturbation response. It suggests the role of supraspinal or midbrain level pathways at the inter-leg coordination during gait.
Subjektive Rechtfertigungselemente bei der Einwilligung -objektive Zurechnung bei »Retterschäden« -spezifischer Zusammenhang bei § 306 b Abs. 2 Nr. 2 StGB Die Schwerpunkte der Examensklausur liegen bei der Frage der Erforderlichkeit subjektiver Rechtfertigungselemente im Rahmen der Einwilligung und bei den Brandstiftungsdelikten: Hier war insbesondere das Zurechnungsproblem der »Retterschäden« zu erörtern und der Frage nachzugehen, ob ein mit der Brandlegung beabsichtigter Versicherungsbetrug nach § 306 b Abs. 2 Nr. 2 StGB strafbar ist. Die nachfolgenden Lösungshinweise sind dabei nicht als »Musterlö-sung« anzusehen; vielmehr werden unproblematische Tatbestände z. T. knapper geprüft, einige Probleme -wie etwa der »Retterschaden« und die Konkurrenzen -hingegen ausführlicher erörtert, als es vom Bearbeiter erwartet wurde. S A C H V E R H A LTFranz (F) ist in finanziellen Nöten. Als er seinem Freund Kai (K), dem Bruder seiner Schwiegermutter Cordula (C), beim Bier von seiner Lage erzählt, hat K eine Idee:Die C habe vor kurzem unverhofft ein sanierungsbedürftiges Wohngebäude geerbt. Es stehe leer, bis auf ein von dem Anwalt A gemietetes Büro im Erdgeschoss. Das Gebäude sei gegen Brand versichert. Es sei doch die Idee, das Gebäude abzufackeln, damit C dann die Versicherungssumme von 300.000 5 kassieren könne -die C würde sicherlich mindestens die Hälfte des Geldes an ihre Tochter, die Ehefrau des F, weiterreichen. Am besten wäre es, wenn der Brand im Büro des A gelegt würde, da die vielen Akten mit Sicherheit richtig gut brennen würden. K erklärt dem F ferner, dass er bei der Aktion gerne mitmache. Der C werde er von alldem natürlich nichts erzählen, er wolle sie nämlich nicht in die Sache hineinziehen.F äußert zunächst Bedenken, da Menschen zu Schaden kommen könnten, lässt sich dann jedoch von K überzeugen, dass »schon nichts passieren werde«, wenn der Brand nachts gelegt würde. Zwar habe ihm die C erzählt, dass der A seine Büroräu-me nachts durch Wachmänner begehen lasse. Das sei aber nicht problematisch. Wenn die Bürofenster nicht erleuchtet seien, könnten sie sicher sein, dass gerade kein Wachgang stattfinde.Weil K ein schlechtes Gewissen bekommt, erzählt er seiner Schwester nachfolgend doch von dem Plan, um ihre Zustimmung zu erhalten. C ist von dem Plan des K wider Erwarten begeistert, da sie kein Geld hat, das Gebäude zu sanieren. Mit ihrem Mieter A habe sie deswegen nur Scherereien. C übergibt dem K sodann einen Schlüssel zu dem Büro des A; dem F erzählt K später, er habe die C unter einem Vorwand um den Schlüssel gebeten und diese habe ihm den Schlüssel ausgehän-digt, ohne den wahren Grund hierfür zu erahnen.Eines Nachts gegen 23 Uhr begeben sich F und K dann zu dem Gebäude. Da die Fenster vom Büro des A nicht erleuchtet sind, öffnen sie die Bürotür vorsichtig mit dem Schlüssel und begeben sich in den Empfangsraum. Der Empfangsraum ist leer.
