Resumo O artigo examina os efeitos da ideia de pessoa no direito a partir de um diálogo entre a visão crítica de Evguiéni Pachukanis, para quem o sujeito de direitos é tão somente uma forma de viabilizar a dominação do capital, e as contribuições críticas de Franz Neumann, Michel Foucault e Judith Butler. Neumann centraliza a pessoa como princípio fundamental do Estado de Direito, em razão da possibilidade de responsabilização sobre a dominação. O sujeito de direitos é compreendido então como centro de imputação de direitos e deveres e autor das normas que regulam sua vida. Foucault analisa o poder como forma dinâmica e circular nas relações sociais. Judith Butler contribui com seu conceito de resistência e analisa a prática da crítica como uma relação social do sujeito com as normas. No interior do direito, podemos compreende-la como uma reivindicação das normas com o objetivo de transforma-las, a fim de possibilitar a expressão de diferentes formas de vida. Sugerimos analisar, em suma, a possibilidade de uma gramática da regulação social e a ideia de pessoa no direito como propulsora de um processo de construção autônoma e constante de critérios normativos, com base na formulação de igualdade dos sujeitos perante o direito.
RESUMOPropõe-se o reconhecimento da perspectiva de gênero nos crimes sexuais cometidos durante a ditadura civil-militar brasileira . A partir da justiça de transição e da criminologia feminista, questiona-se os mecanismos utilizados para investigar os crimes cometidos no período, atenta-se para a possibilidade de revitimização face à inadequação desses métodos e convoca ao desvelamento do posicionamento ideológico do Estado nas violências sexual e de gênero. O objetivo é diagnosticar a ausência da perspectiva nos estudos dos crimes sexuais cometidos durante o regime e na reconstrução da memória e da verdade, pilares da justiça de transição, para projetar perspectivas mais justas.
ABSTRACTIt is proposed the recognition of the gender perspective in sexual crimes committed during the Brazilian civil-military dictatorship . From the transitional justice and feminist criminology, we question the mechanisms used to investigate crimes committed in the period, emphasize the possibility of victimization due to the inadequacy of these methods and call the unveiling of the ideological position of the state in sexual and gender violence. The goal is to diagnose the lack of perspective in studies of sexual crimes committed during the regime and in the reconstruction of memory and truth, transitional justice pillars, to design more equitable perspectives.
<p>O artigo apresenta uma a análise da inserção cultural do crime, do controle da criminalidade e das emoções envolvidas nesses fenômenos, pelo prisma da Criminologia Cultural, uma abordagem recente nos estudos criminológicos, oferecendo uma base necessária para qualquer estudo das necessidades para a formação da cidadania, realizado no contexto das sociedades urbanas pós-moderna, e pois, de modernidade tardia. Nesse sentido, apresentam-se esses fenômenos em relacionados ao individualismo, à criatividade e à geração de estilo de vida, em um período de privações materiais e ontológicas, enfatizando a força da mídia de massa como influenciadora da subjetividade humana.</p>
O artigo pretende apresentar o papel das reivindicações sociais na gramática do direito a partir da análise da mobilização dos institutos dogmáticos do nome e do sexo civis nas demandas jurídicas por retificação do registro civil de pessoas trans. O objetivo é demonstrar como as lutas sociais, ao expressarem-se na gramática do direito, estruturam disputas sobre os significados dogmáticos de instituições jurídicas e, assim, possibilitam uma avaliação crítica da regulação disponibilizada.
